Your Committee on Planning, to which was referred Bill No. 92, transmitted by Mayor Stephen
K. Yamashiro per Communication No. 327, dated May 20, 1997, regarding the change of zone
request by Marion P. K. Bush at Kahauloa 2nd, South Kona, Hawaii, TMK: 8-2-08:57, reports
as follows:
Bill No. 92 amends Section 25-8-4 (South Kona Zone Map), Article 8, Chapter 25 (Zoning
Code) of the Hawaii County Code, by changing the district classification for approximately
7.429 acres of land from Agricultural (A-Sa) to Family Agricultural (FA-la) zoned district.
The subject property is located along the north side ofNapo'opo'o Road and adjacent (makai) to
the old coffee mill where the applicant intends to subdivide the property into a total of six lots
with the minimum one acre lot size. Two of the lots aze intended to be sold for the purpose of
providing funds for the necessary infrastructure.
The subject property, an irregular-shaped lot, is situated within the Special Management Area
and the Kealakekua Bay Historic District. Therefore, a Special Management Area Use Permit
Application and compliance with Chapter 343 (EIS) will be required.
Access to the subject property will be from Napo'opo'o Road which has a 50-foot wide right-of-
way.
Soils within the subject property have been classified as "E" or Very Poor for agricultural
productivity by the Land Study Bureau's Detailed Land Classification System and the soils
within the subject property are unclassified by the Agricultural Lands of Importance to the State
of Hawaii (ALISH) system.
Water is provided to the subject property by an existing 8-inch county water line along
Napo'opo'o Road.
The subject property has no severe geological or topographical problems which cannot be
properly rectified or which would render the land unusable. Lands surrounding the subject
property aze zoned A-Sa and A-la.
The subject property was used for cattle grazing and agricultural purposes. Therefore it is not
anticipated that endangered or threatened candidate species of flora or fauna nor significant
azchaeological sites are located on the subject property.

Your Committee concurs with the following reasons by the Planning Commission and the
Planning Director for recommending a favorable consideration for the change of zone request:
1. The change of zone request conforms with the goals, policies and standazds of the
General Plan.
2. The proposed reclassification is consistent with General Plan Land Use Pattern
Allocation Guide (LUPAG) Map which designates the area for Orchazds.
3. All essential services and utilities, including water, wastewater and roadways will
be provided.
Your Committee amended Bill No. 92 by including conditions and language used consistently in
similaz zoning bills, specifically adding Council's standard condition regarding the applicant's
fair share contribution to mitigate potential regional impacts as it relates to the subdivision of lots
of one acre in size or less. Language in Condition H was deleted because rollback taxes aze
enforceable pursuant to Chapter 19 (Real Property Tax Code).
Your Committee on Planning is in accord with the intent and purpose of Bill No. 92, Draft 2, and
recommends that it pass first reading.
