Yamashiro via Communication No. 244, dated April 7, 1997, relating to minimum yards, reports as follows: Bill No. 74 amends Section 25-5-7 relating to minimum yards in the Single Family Residential (RS) District and 25-5-26 relating to minimum yards in the Double Family Residential (RD) District, Chapter 25 (Coning Code) of the Hawaii County Code. The purpose of Bill No. 74 is to delete reference to story for a building under the minimum side yard requirements within the applicable zoned districts. When reviewing a building plan, the Planning Director is concerned with the physical mass of the structure in relationship to the building site and boundaries and not so much with the interior levels of the structure. For example, there are concerns as to whether the definition of a story would be applied to a building which may be constructed as tri-levels interconnected with one, two or three steps. Deleting reference to story would still be consistent with the intent and purpose of the minimum yard requirements which are to ensure that adequate air and light circulation is sufficient between structures. Your Committee also noted that these affected districts have height limitations of thirty five feet. Your Committee on Planning is in accord with the intent and purpose of Bill No. 74 and recommends that it pass first reading.
