Your Committee on Planning, to which was referred Bill No. 391, transmitted by the Planning
Commission dated January 23, 1991, regarding the change of zone request by Kamehameha
Schools/B.P. Bishop Estate at Kahaluu, North Kona, Hawaii, TMK 7-8-] O:Portion of 4, reports
as follows:
Bill No. 391 amends Section 25-87 (North Kona Zone Map), Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code by changing the district classification for approximately
10.375 acres of land from Unplanned (U) to a Village Commercial (CV-7.5) zoned district.
The subject property is located to the northeast (mauka) of the Keauhou-Kona Convenience Store
and Shopping Village -Increment II where the applicant proposes to construct an office complex
which would tie in with the existing Keauhou Shopping Village. The preliminary design concept
for the proposed development consists of a garden office complex consisting of four two-story
buildings centered around a pedestrian courtyard. The buildings will have approximately
130,000 square feet of gross floor area.
Bill No. 391 passed first reading by the Council on March 6, 1991 and was referred back to the
Planning Committee for further discussion. Additional time was requested by the applicant to
resolve an overall curb, gutter and sidewalk plan that would be acceptable to both the County and
the applicant.
Concurrently, the applicant went through a reorganization and has now refocused on its proposed
development.
Primary access to the subject property would be from Kamehameha III Road, which is a county
road having a 100-foot wide right-of--way and serves as a secondary arterial.
Water is available to the subject property and sewage will be disposed of at the Heeia sewage
treatment plant.
The subject property is affected by three archaeological sites: a trail, a planting area, and a larger
planting area. The planting areas were evaluated as being significant for their informational
content. The trail was evaluated as being significant for its informational and cultural content.
Based on the Cultural Resource Management Plan for Keauhou, further data recovery work is
recommended.

An historic preserve has been designated on the Keauhou Master Plan adjacent and to the north
of the affected commercial development. The historic preserve contains the Ohia Cave complex
as well as other archaeological features.
Surrounding uses near the subject property include the Hillhaven Medical Caze facility, golf
course and condominiums across Kam III Road, Keauhou Shopping Village, single family
residences and vacant lands.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending favorable consideration for the change of zone request.
The applicant's representative noted that the subject property may not need a Shoreline
Management Area (SMA) permit because the boundaries may have changed due to the Planning
Commission's recent SMA boundary amendment.
Your Committee expressed some concerns to the proposed mauka office complex and
Kamehameha III Road access but was reassured that the proposed development will still require
approval from the Department of Public Works.
Your Committee amended Bill No. 391 by including the following conditions and language used
consistently in similar zoning bills and to update and clarify its conditions:
1. Amending the tax map key parcel number to reflect the updated parcel number to
read as 7-8-10:Portion of 2 (Formerly Portion of 4);
2. Adding the standard water commitment payment condition;
3. Rewording and incorporating conditions relating to the standazd condition relating
to construction of the commercial development and securing final plan approval
to current time frames;
4. Amending Condition E relating to intersection improvements by deleting the
requirement to signalize and channelize the three intersections. Two of the three
intersections have already been signalized and channelized. Language has been
added requiring the applicant to design and construct the interior driveway
circulation improvements to interconnect with the existing adjoining commercial
properties south of the subject property meeting with the Department of Public
Works;

5. Adding the standard condition relating to a Solid Waste Management Plan;
6. Adding a condition that the applicant shall connect to its existing sewage
treatment plant near E Ieeia Bay meeting with the requirements of the appropriate
agency; and
7. Amending other conditions to reflect standard language used consistently with
similar zonings.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 391, Draft 2,
and recommends that it pass second and final reading. However, under the circumstances
regarding Bill No. 391, Drat 2, and the subject property's updated new tax map key parcel
number, Your Committee recommends that Bill No. 391, Draft 2, receive an additional reading at
the subsequent Council meeting to secure its approval.
