Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 1503, regarding Resolution 775-08, reports as follows: ,
Resolution 775-08, transmitted by Assistant Corporation Counsel Gerald Takase via
Communication No. 1503, dated October 6, 2008. This proposed resolution authorizing the
abandonment and sale of that certain road remnant fronting Oshima Store, situate at Kainaliu, i
North Kona, County and State of Hawaii, to CEOK LLC, an area of 714 square feet, identified!.
as Tax Map Key: (3)7-9-007:038.
There was no testimony from members of the public regarding the proposed acceptance.
Assistant Corporation Counsel Gerald Takase appeared before your committee. Mr. Takase
confirmed the realignment of Mamalahoa Highway through Kainaliu Village in North Kona,
Hawaii, created a remnant fronting the Oshima store property owned by CEOK LLC, who
has expressed a desire to acquire this remnant. This will allow Oshima to expand its store
towards the street by about seven feet, bringing the storefront even with others along Mamalahoa
Highway in Kainaliu. ,
Pursuant to section 2-110, Hawaii County Code; this roadway is economically and physically '
unsuitable or undesirable for development or utilization as a separate unit by reason of its
location, size and shape, and is hereby declared a remnant; pursuant to sections 2-] 71 and 2-118,
the Council may direct the Director of Public Works to dispose of real property without recourse
to public auction and shall first be offered for sale to the abutting landowner, CEOK LLC,
subject to the following: 1) buyer to pay all cost of surveying, and subdivision; and 2) buyer to'.
consolidate remnant with its property within one year.
Public Works Director Bruce McClure and Traffic Division Chief Ron Thiel appeared before
your Committee. Mr. McClure and Mr. Thiel commented on the removal of the diagonal
parking spaces fronting Oshima store in addition to other improvements including a loading zone
and parallel parking spaces.

Council member Bob Jacobson expressed concern regarding funds previously spent in Kainaliu
to address parking and road work in front of Oshima store about six months ago. Mr. Jacobson
commented on the need for better planning and coordination of these projects to avoid financial;
waste.
Committee chair Brenda Ford commended the excellent on-going work by Department of Public
Works and their effort to help the retailers in Kainaliu with sidewalk improvements and
simultaneously dealing with the traffic issue through this area. Ms. Ford added that the retailers
are appreciative of the measures DPW has taken to Lessen impact to their businesses by having a
blackout period from November 27, 2008 through January 1, 2009 and doing some of the work
at night. Ms. Ford urges the support of her colleagues on this proposed resolution.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose
and intent of Resolution 775-08, and recommends its adoption.
