Bill No. 73 amends Section ~-K-3 ~ A'orth Kona Zone Map), Article 8, Chapter 25 (Zoning
Code) of the Hawaii County (~odc. h~ changing the district classification for approximately
5.919 acres of land from Agricultural l~A-5a) to Single Family Residential (RS-10) zoned district.
The subject property is located on the mal:ai side of Mamahrhoa Highway and north of Kona
Palisades subdivision, appro>:imatcl ~ ~~9 Feet north of Ka'iminani Drive and borders Kebke'o
and Oneone Streets, where the ?pplic?n~ proposes to develop a eighteen (18)-lot residential
subdivision with minimwn I u_UUU ,y~,iarc toot lots.
Concurrently, the applicant is, also rc~;ucuing a state land use boundary amendment for the
subject property from an agricultural u~ an Urban district.
The subject property, a rect~u~~~ular ,hoped lot. dots not have any structures nor any agricultural
activities. The property was ~,~ruhb~:d I~~~ the owners.
Access to the subjectpropert~ ~~uu!~I Inc be the privately-owned Oneone Street which connects to
Ka'iminani Drive, having a ~U-foot ri~Jit-of--way width and a 20-24 foot wide pavement. The
Oneone Street access would >cn c I,ni, wen lots proposed within the subject property. The
privately-owned Kebke'o SIrCCI acr~> h:rviug a ~0-foot wide right-of--way with a 20-foot wide
pavement would serve the rcnuiining ;~uu~ lots.
Soils within the subject prupert~~ han c been classiYled as "E" ar Very Poor for agricultural
productivity by the Land Stuci~ Iiurc.n(s Uctail i,and Classification System and the soils within
the subject property are uncl~rsil ice b~ the agricultural Lands oflmportance to the State of
Hawaii (ALISH) system.
Water is provided to the subject pro~~ei i~ by an existing 6-inch county water line from the end of
Kebke'o Street. Water availa'~iiii~ limited to a total of seven units. The additional ll units
would require extensive water ,c,tcu~ ':~cilities to be eonstructe~d.
Because the subject propert}~ siuinir.l within the Critical Wasterwater Disposal Area, the
applicant would be required In ~lisp~"c ~uistewater into septic tank systems.

The subject property has no severe geological or topographical problems which cannot be
properly rectified or which would render the land unusable. There are no significant drainage
ways on the subject property.
Vegetation consists of primarily an over story of Christmas berry, lama, alahe'e, kukui, mango
and purple strawberry guava. Ground cover consists of primarily laua e, bitter yam, lantana, air
plant, noni and ferns. Because the subject property was previously cleared, it is unlikely that
there are any archaeological features remaining.
Adjacent lands immediately to the north of the subject property are zoned A-Sa and A-la, lands
to the east are zoned A-Sa and RS-10, and lands to the south and west are zoned RS-10. The
subject property is located adjacent to a property owned by Ken World which recently received
approval for a similar single family residential land use designation.
Your Committee concurs with the following reasons by the Phmning Commission and the
Planning Director for recommending a favorable consideration for the change of zone request:
1. The change of zone request conforms with the goals, policies and standards of the
General Plan.
2. The proposed reclassification is consistent with General Plan Land Use pattern
Allocation Guide (LUPAG) Map which designates the area for Urban Expansion
Area.
3. The Kona Regional Plan recommends the area for residential (four units per acre).
4. All essential services and utilities, including water, wastewater and roadways will
be provided.
Your Committee amended Bill No. 73 as follows:
1. Condition E was amended by replacing "Department" with "Director";
1. Condition F was amended by clarifying the language relating to roadway
improvements; and
2. Condition K was amended by replacing the existing language with Council's
standard language relating to the applicant's fair share assessments.

Written testimony from a homeua ner in the Matsumoto Subdivision which has access to
Ke'oke'o Street noted that the applicant has only a 25°!° undivided interest in the roadway lot.
Harue Matsumoto has 25% undivided interest and the remaining 50% undivided interest is
owned by Morris Scandal "]l u5t. "I herefore, Your Committee further amended Bi1173, as
amended, by clarifying languar in Condition F that the applicant's ownership interest in the
Ke'oke'o Street roadway im~,~ro~cmcnts he dedicated to the County upon its request.
Yaur Committee on Plannin;~ is in accord kith the intent and purpose of Bill No. 73, Draft 3,
and
recommends that it pass first reading.
