Your Committee on Planning, to which was referred Bill No. 62, transmitted by Mayor Stephen
K. Yamashiro per Communication No. 267 dated Mazch 2, 1995, regazding the change of zone
request by Kamehameha Investment Corporation at Kahaluu, North Kona, Hawaii,
TMK 7-8-IO:Portion of 50, reports as follows:
Bill No. 62 amends Section 25-87 (North Kona Zone Map), Article 3, Chapter 25 (Zoning Code)
of the Hawaii County Code by changing the district classification for approximately 21.319 acres
of land from and Unplanned (U) to a Single Family Residential (RS-IS) zoned district.
The subject property is located on the mauka side of Kealii Street, mauka of the Keauhou Estates
Subdivision where the applicant intends to subdivide the subject property into forty-five lots
ranging from 15,000 to 24,000 squaze feet. At the time, the applicant intended to replenish the
supply of residential lots to meet the present and near-future demand of residential units in the
resort and to fulfill Kamehamea Investment Corporation's (KI(') long-term goal of developing a
master-planned, resort-residential community.
Bill No. 62 has been deferred in the Planning Committee since 1995. According to the
applicant's representative, KIC has gone through a reorganization and has now refocused on its
proposed development.
Primary access to the subject property would be from Kamehateha III Road, which is a county
road having a 100-Foot wide right-of--way with 24-foot wide pavement and 8-foot wide gravel
and paved shoulders. Access from Kamehameha III Road which serves as a secondary arterial
connecting Kuakini Highway to the subject property is via Kealii Street, a private roadway with a
pavement width of 20 feet within a 50-foot wide right-of--way. Kaluna Street, also a private
roadway with a pavement width of 40 feet within a 60-foot wide right-of--way, provides access
from the subject property going southwest and eventually connecting to Alii Drive.
Water is available to the subject property through an existing 16-inch waterline located along
Kealii Street and sewage will be disposed of at the Heeia sewage treatment plant.
An intensive azchaeological inventory study of the subject property was conducted in May and
April 1991 by International Archaeological Research Institute, Inc. Four new azchaeological
sites and one known archaeological site was discovered on the subject property. The one known
site is an old, abandoned railroad berm which runs in a north-south direction along the entire
eastern (mauka) boundary of the subject property. The railroad berm which is part of a lazge
berm which runs for several miles to the south of the subject property was constructed in the

early 1920's by the West Hawaii Railroad and is considered to be historically and culturally
significant.
Two of the newly identified sites, consisting of walls, terraces, mounds and enclosures, appear to
have been used for agricultural purposes. The third site is associated with past cattle ranching
activities. These sites are considered significant solely for their information content. The last of
the newly discovered sites is a lava tube within which two burials were found with a cluster of
agricultural features lying adjacent to the lava tube.
Mitigative measures include that the old railroad berm be preserved and restored, further data be
collected for the two agriculturally-related sites and adjacent to the burials, and treatment for the
burials. The Hawaiian Island Burial Council has recommended that the burials be covered with
cloth and the lava tube be collapsed and the ground surface above the collapsed lava tube be left
in its natural state.
Surrounding uses near the subject property consists of single and multiple family residential,
resort, commercial, recreational and other related uses.
Your Committee concurs with the following reasons by the Planning Commission and the
Planning Director for recommending a favorable consideration For the change of zone request:
1. The change o1' zone request conforms with the goals, policies and standards of the
General Plan.
2. The proposed reclassification is consistent with General Plan Land Use pattern
Allocation Guide (LUPAG) Map which designates the area for Urban Expansion
Area.
3. The Kona Regional Plan recommends the azea for residential (four units per acre).
4. All essential services and utilities, including water, wastewater and roadways will
be provided.
Your Committee expressed their concerns to the comments from the State Department of
Transportation requiring that conditions be imposed relating to roadway improvements. Your
Committee requested that staff contact the Department of Public Works and the State
Department of Transportation regarding such comments.
Your Committee amended Bill No. 62 by including the following conditions and language used
consistently in similar zoning bills and to update and clarify existing conditions:

1. Adding the standard water commitment payment condition;
2. Deleting the park dedication condition;
3. Amending the affordable housing condition to reflect standard housing condition;
4. Adding the standard drainage condition;
5. Adding the standard fair share contribution condition to mitigate potential
regional impacts;
Your Committee on Planning is in accord with the intent and purpose of Bill No. 62, Draft 2, and
recommends that it pass first reading.
