Your Committee on Planning, to which was referred Bill No. 16, transmitted by Mayor Stephen
K. Yamashiro per Communication No. 61, dated December 27, 1996, regarding the change of
zone request by Robert F. Greenwell Company, L.P. at Honokohau 1st and 2nd, North Kona,
TMK: 7-4-5:2, reports as follows:
Bill No. 16 amends Section 25-86 (North & South Kona Zone Map), Article 3, Chapter 25
(Zoning Code) of the Hawaii County Code, by changing the district classification for
approximately 85.396 acres of land from an Agricultural (A-20a) to an Agricultural (A-l0a)
zoned district.
The subject property, between the elevation of 1700 feet and 2300 feet, is located one mile
southeast of the Mamalahoa Highway/Palani Junction and 2,200 feet mauka of the Mamalahoa
Highway where the applicant wants to subdivide the subject property into five lots of 10 to 36
acres for the purpose of transferring individual title to family members.
Access to the subject property is by way of Mamalahoa Highway on a 60-foot wide private
roadway and further over a 60-foot wide road and utility easement which will be used by the
Department of Water Supply as an access to the Honokohau Production Well site. The
Department of Water Supply is in the process of improving the access with a 12-foot wide paved
road.
In recent years, approximately half the subject property has been grubbed and planted in pasture.
The balance of the property is overgrown with primarily non-native trees and underbrush.
Soils within the subject property have been classified as "E" ur Very Poor for agricultural
productivity by the Land Study Bureau's Detail Land Classification System and the Agricultural
Lands oflmportance to the State of Hawaii (ALISH) system classifies the soils within the subject
property as "Other Important Agricultural Lands."
County water is not available to the subject property because the property is outside the service
area of the North Kona Water Systcm at an elevation above the existing County water system.
Extensive improvements and additions, including storage, transmission, booster pump, and
distribution facilities must be constructed. The applicant proposes to extend a privately operated
system to serve the proposed development.

Due to the location of a drinking water well within 1000 feet of the subject property, no cesspool
or septic tank system is allowed to be built within the 1000 feet radius.
Adjacent lands to the north and south are zoned A-20a and aze either vacant or used for grazing
and lands to the west side are zoned A-1 a.
The subject property has no severe geological or topographical problems which cannot be
properly rectified or which would render the land unusable.
According to the Department of Land and Natural Resources-Historic Preservation Division, the
prabability of historic sites existing on the subject property is low. Fences, stone walls, and a
water tank, some or all of which may qualify as historic sites, are noted as occurring elsewhere
on the subject property. A preliminary survey and interview with the owner of the subject
property is recommended to identity and evaluate the presence/absence of historic sites.
Your Committee concurs with the following reasons by the Planning Commission and the
Planning Director for recommending a favorable consideration for the change of zone request:
1. The zone request is conforms to the goals, policies and standazds of the General
Plan.
2. The zone request conforms to the General Plan's Land Use Pattern Allocation
Guide (LUPAG) Map which designates the area as Orchard.
3. All essential services and utilities, including water, wastewater and roadways will
be provided.
Your Committee amended Bill No. 16 by including language used consistently in similaz zoning
bills. Also, Condition C was amended by requiring the applicant to construct off-site water
system improvements, which include but are not limited to storage, transmission, booster Bump,
and distribution facilities meeting with the requirements of the Department of Water Supply.

Your Committee on Planning is in accord with the intent and purpose of Bill No. 16, Draft 2, and
recommends that it pass first reading.
