Yamashiro per Communication No. 74, dated December 27, 1996, regarding the change of zone request by Hao Street Hui at Kaloko, North Kona, TMK: 7-3-25:4, reports as follows: Bill No. 24 amends Section 25-86 (North & South Kona Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 22.065 acres of land from an Agricultural (A-20a) to an Agricultural (A-Sa) zoned district. The subject property is located in the Kaloko Mauka Subdivision st the 2,500-foot elevation and on the north side of Hao Street where the applicant, a Hawaii General Partnership, is the fee owner of the subject property. The applicant intended to subdivide the property into a total of six lots in sizes of 3 and 4 acres. However, in reviewing the request, the Planning Commission further considered Council Resolution No. 330-96 regarding the established pattern for rezoning in the Kaloko Mauka azea. In the resolution, the Council recognized that rezoning ordinances have established a pattern of A-3a lots up to the 2,600 foot elevation and A-Sa lots within a band between the 2,600 to the 2,900 foot elevation. To remain consistent, the Commission voted to recommend the approval of Agricultural (A-Sa) lots based on Council's findings rather than the applicant's initial request for the A-3a designation. Access to the subject property is off Hao Street via Kaloko Drive which has a 22-foot wide pavement and 8-foot grassed shoulders within an 80 foot right-of--way. Soils within the subject property have been classified as "E" or Very Poor for agricultural productivity by the Land Study Bureau's Detail Land Classitication System and the Agricultural Lands of Importance to the State of Hawaii (ALISH) system classifies the soils within the subject property as "Unique Agricultural Lands." An archaeological study was not conducted on the subject property. Water is provided to the subject property by a 4-inch county water line along Hao Street fronting the subject property. The subject property is located in the Critical Wastewater Disposal Area where cesspools are not allowed because of water pollution concerns. Any development on these lots would require all wastewater to be disposed into a septic tank system. PC REPORT NO.: 2 4 PC- 2 4 Page 2 Januazy 28, 1997 Adjacent lands are zoned A-3a to the west and immediately surrounding the subject property to the east and north aze lands zoned A-20a. The subject property has no severe geological or topographical problems which cannot be properly rectified or which would render the land unusable. The subject property is below the elevation recommended as an essential habitat of the Alala, an endangered bird whose population has reached an extremely critical state. Based on recommendations of the Alala Recovery Plan, the portion of lands of Kaloko above approximately 3,200 feet to 3,400 feet elevation, including all parcels in Blocks 8 thna 13 of the Kaloko Mauka Subdivision, is designated as essential habitat for the Alala. The Planning Commission concurs with the following Planning Director's reasons for recommending a favorable consideration for the change of zone request: 1. The zone request is conforms to the goals, policies and standazds of the General Plan. 2. The zone request conforms to the General Plan's Land Use Pattern Allocation Guide (LUPAG) Map which designates the area as Orchazd. 3. All essential services and utilities, including water, wastewater and roadways will be provided. Your Committee amended Bill No. 24 by including language used consistently in similar zoning bills. Your Committee on Planning is in accord with the intent and purpose of Bill No. 24, Draft 2, and recommends that it pass first reading.
