Yamashiro per Communication No. 65, dated December 27, 1996, regarding the change of zone request by Towne Development of Hawaii at Pahoehoe 3rd, North Kona, Hawaii, TMK: 7-7-08:30 and 96, reports as follows: Bill No. 22 amends the Section 25-87 (North Kona Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 14± acres of land from Unplanned (U) to Single Family Residential (RS-15) zoned district. The subject property is located on the makai side of Kuakini Highway and northeast of the White Sands Beach Estates Subdivision where the applicant intends to subdivide the property into thirty- 15,000 square foot lots. Concurrently, the applicant is also requesting a State Land Use Boundary Amendment for the subject property from the Agricultural to the Urban District. Taiyo Hawaii Company, Ltd. is [he owner of TMK: 7-7-8:30 which consists of approximately 7± acres and Karen Kobayashi and Katherine Staton are the owners of TMK: 7-7-8:96 which consists of approximately 5.8± acres. The subject property, rectangular-shaped and slightly sloping, is proposed to be incorporated into the adjacent proposed Keauhou View Estates subdivision which is a 387-lot subdivision zoned for Single Family Residential in 1983. In May 1996, the ordinance was then amended by Ordinance No. 96-60 by amending the conditions of approval. Access to the subject property will be via subdivision roadways from the adjacent proposed Keauhou View Estates Subdivision. The proposed Alii Highway will traverse along the makai boundary of the project site. For agricultural productivity by the Land Study Bureau's Detail Land Classification System, soils within the mauka area of the subject property have been classified as "D" or Poor and in the makai area as "E" or Very Poor. The Agricultural Lands of Importance to the State of Hawaii (ALISH) system classifies the soils within the mauka portion of the subject property as "Other Important Agricultural Lands" and the makai portion of the subject property is unclassified. An archaeological study was not conducted on the subject property. PC REPORT NO.: 2 3 PC- 2 3 Page 2 January 28, 1997 Water can be made available to the subject property from an existing 12-inch County water line which along Kuakini Highway. "the property has a water commitment of 30-units of water. The wastewater from the project will be disposed of by the prevailing requirements of the Department of Health's rules and regulations to be installed by the respective homeowners. The Flood Insurance Rate Maps (FIRM) indicate that the subject property is located in Zone "X" area outside the 500-year flood plain. There are no significant drainage ways anticipated. The subject property is within the SMA boundary. The applicant will file an SMA application prior to commencement of any development within the area. An azchaeological inventory survey, including subsurface testing was conducted by Archaeological Consultants of the Pacific, [nc. A 100 percent surface survey of the project azea was under taken where a total of I 1 sites where identified composing of 15 features. In addition, seven previously recorded sites were identified. Six were walls constructed of stacked boulders and cobbles (including the Great Wall of Kuakini), while one site was an agricultural complex composed of 15 features. No habitation structure remains, burial sites, lava tubes or religious monuments and features were located on the subject property. The subject property is adjacent to Keauhou View Estates Subdivision and to the east is the White Sands Estates Subdivision both zoned RS-7.5. Lands to the north are also zoned RS-7.5. The subject property has no severe geological or topographical problems which cannot be properly rectified or which would render the land unusable. The Planning Commission concurs with the following Plamling Director's reasons for recommending a favorable consideration for the change of zone request: 1. The zone request is conforms to the goals, policies and standards of the General Plan. 2. The zone request conforms to the General Plan's Land Use Pattern Allocation Guide (LUPAG) Map which designates the area for Urban Expansion Area. 3. The zone request is consistent with the Kona Regional Plan which recommends the azea for residential four units per acre. 4. All essential services and utilities, including water, wastewater and roadways will be provided. PC REPORT NO.: 2 3 PC- 2 3 Page 3 Januazy 28, 1997 Your Committee amended Bill No. 22, with the circulated Draft 2, by including language used consistently in similaz zoning bills. Because the subject property will be developed into the proposed Keauhou View Estates subdivision and Ordinance No. 96-60 conditions of approval did not have the second dwelling prohibition, Your Committee further amended Bill No. 22 by deleting the new Condition P relating to the prohibition of a second dwelling. Your Committee on Planning is in accord with the intent and purpose of Bill No. 22, Draft 3,.and recommends that it pass first reading.
