Yamashiro per Communication No. 63, dated December 27, 1996, regazding the change of zone request by Peter Dungate at Kaloko, North Kona, Hawaii, TMK: 7-3-8:32, reports as follows: Bill No. 19 amends Section 25-87 (North Kona Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 4.910 acres of land from an Agricultural (A-1 a) to a Residential and Agricultural (RA-1 a) zoned district. The subject property, situated in proximity to residential subdivisions such as Kona Palisades, is located along the south side of Kaloko Drive, approximately 200 feet mauka of the Hawaii Belt Road where the applicant intends to subdivide the property into four lots. The proposed subdivision plan reflects three 1-acre lots with the balance of 1.910 acres making up remaining lots. Concurrently, the applicant is also requesting a State Land Use Boundary Amendment which would change the district classification of the subject property from the Agricultwal to the Rural district. The applicant has stated that they will be able to do backyard floriculture or citrus products type of agricultural activities on the one or two lots he plans to retain and the balance of the lots to be sold at mazket price. Access to the subject property would he via the Old Kona Belt Road which has aright-of--way of approximately 30 feet and pavement ranging between 12-14 feet with 2-3 foot wide shoulders on both sides of the road. Soils within the subject property have been classified as "D" or Poor for agricultural productivity by the Land Study Bureau's Detail Land Classification System and the Agricultural Lands of Importance to the State of Hawaii (ALISH) system classifies the soils within the subject property as "Other Important Agricultural Lands." An archaeological study was not conducted on the subject property. Water is provided to the subject property by a 6-inch county water line which fronts the subject property. 1'C REPORT NO.: 2 0 ~i PC- 20 Page 2 January 28, 1997 The subject property is located in the Critical Wastewater llisposal Area where cesspools aze not allowed because of water pollution concerns. Any development on these lots would require all wastewater to be disposed into a septic tank system. The subject property has no severe geological or topographical problems which cannot be properly rectified or which would render the land unusable. The Planning Commission concurs with the following Planning Director's reasons for recommending a favorable consideration for the change of zone request: ] . The zone request is conforms to the goals, policies and standazds of the Genera] Plan. 2. The zone request conforms to the General Plan's Land Use Pattern Allocation Guide (LUPAG) Map which designates the area as Orchards. 3. The zone request is consistent with the Kona Regional Plan and its Zone Guide Map which suggest the area for low density residential uses. 4. All essential services and utilities, including water, wastewater and roadways will be provided. Your Committee amended Bill No. 19 including language used consistently in similar zoning bills. Your Committee discussed the applicant's fair share contribution in Condition K relating to the traffic assessments in which the monies collected would go to the construction of intersection improvements at Kaloko Drive and Mamalahoa Highway.
