PLACE: Kona Surf Hotel, King Kamehameha Ballroom TIME: 10:15 a.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. l5, transmitted by Mayor Stephen K. Yamashiro per Communication No. 60, dated December 27, 1996, regarding the change of zone request by Robert J. Henriques and Gregg R. Kashiwa at Kalaoa 3rd, North Kona, TMK: 7-3-02:02, reports as follows: Bill No. 15 amends Section 25-86 (North and South Kona Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 15.253 acres of land from an Agricultural (A-20a) to an Agricultural (A-3a) zoned district. The subject property is located on the mauka side of Hawaii Belt Road across from Kona Coastview Subdivision where the applicants wish to subdivide the property into five lots in 3- acre sizes. Access to the subject property is from Mamalahoa Highway, a State highway. Water for the proposed subdivision will be provided by the existing County's North Kona Water System. However, the applicant will be required to install a waterline approximately 700 feet from a point north of the Kalaoa Booster Pumps to the parcel. Wastewater generated by the proposed development will be disposed of utilizing an individual wastewater disposal system meeting with the approval of the State Department of Health. Soils within the subject property have been classified as "E" or Very Poor for agricultural productivity by the Land Study Bureau's Detail Land Classification System and the Agricultural Lands of Importance to the State of Hawaii (ALISH) system does not classify the soils within the subject property. An archaeological study was not conducted on the subject property. Lands adjacent to the north, south and east are vacant lands with scattered residences. Across Mamalahoa Highway, to the west and southwest arc the Kona Coastview, a 286-lot subdivision; Kona Highlands, a 365-lot subdivision; Kalaoa View Estates, a 56-lot subdivision; and Kona Wonderview, a 94-lot subdivision. The Planning Commission concurs with the following Planning Director's reasons for recommending a favorable consideration for the change of zone request: PC REPORT NO.: 18 PC- 18 Page 2 January 28, 1997 1. The zone request is consistent with the goals, policies and standards of the General Plan. 2. The zone request is consistent with the General Plan's Land Use Pattern Allocation Guide (LUPAG) Map which designates the azea as Extensive Agricultural and Orchards. 3. All essential services and utilities, including water, wastewater and roadways will be provided. Public testimony from adjacent landowners east of the subject property expressed concerns relating to the 4-acre discrepancy in land area of the subject property which does not match the land area shown on the tax maps. Concerns were also expressed relating to the existing family cemetery on the subject property which was established in the eazly 1800's and traffic and water improvements. In response to the concerns, the applicants stated that the subject property was purchased via a Partition Action in the Third Circuit Court with full knowledge that the land area was based on a very old survey with no warranty from the Commissioner as to its exact size. After the sale was confirmed, the applicants had a survey made by Imata & Associates, Inc. to determine the true land area. Your Committee amended Condition C of Bill No. 15 to clarify off-site water system improvements, added a standard compliance with affected agencies condition, and added other language used consistently in similar zoning bills. Your Committee also requested that a proposed draft be considered at the bill's first reading which includes the standard fair share condition and a condition prohibiting ohana and condominium property regimes (CPR). The applicants agreed to all of the conditions for approval but felt that in the event that they may not be unable to meet all of the zoning requirements, other alternatives would need to be considered. It was noted by Your Committee that ohana dwellings are not permitted on agricultural lots and reference should be made in regards to farm dwellings.
