Home My WebLink AboutREP PC 017 01/21/1997 1996-1998 REPORT OF THE COMMITTEE ON PLANNING DATE: January 21, 1997 Re: C-4364 ~ PLACE: Councilroom TIME: 2:45 p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 703 transmitted by the Planning Commission via Communication No. 4364, dated November ] 0, 1992, relating to shoreline setback line regulation, reports as follows: Bill No. 703 amends Chapter 25-42 (Zoning Code) of the Hawaii County Code, as amended, relating to shoreline setback line regulations and referencing Planning Commission Rule 8. The purpose of the bill is to delete the shoreline setback line regulations from the zoning code. Section 25-42 was adopted pursuant to Chapter 205-32 and 205-34 of the Hawaii Revised Statutes, which required the counties to establish shoreline setbacks. In 1989, the Legislature made sweeping changes to the law by repealing old sections and amending the Coastal Zone Chapter with new procedures, making Section 25-42 functionally obsolete. Act 356, 1989 Sessions Laws of Hawaii, has required the County to establish shoreline setback lines by rules. Bill No. 703 was deferred at the Planning Committee's November 30, 1992 meeting. The Planning Commission has adopted amendments to its Rule 8 relating to shoreline setback which now conforms to the statutory definitions and procedures for establishing shoreline setbacks. Recently, the County also adopted revisions to the Zoning Code which deleted any reference to Shoreline setback line regulations. In view of the above, Your Committee on Planning recommends that Bill No. 703 be filed.
