Your Committee on Planning, to which was referred Bill No. 360 transmitted by Takashi
Domingo, Planning Committee Chairman via Communication No. 1427, dated October 7, 1996,
relating to council-initiated bill to amend Ordinance No. 706, reports as follows:
Bill No. 360 amends Ordinance No. 706 which amended section 25-107 (Pahoa Zone Map),
Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, as amended which reclassified
certain lands from Single Family Residential (RS-15) to Village Commercial (CV-10) at
Waiakahiula, Puna, Hawaii, TMK:l-5-13:35.
The purpose of the amendment to Condition I of Ordinance No. 706 is to require a 6-foot high
chain link fence between the proposed and existing developments and the adjacent properties to
the east to be constructed and completed within thirty days from the effective date of this
ordinance.
Patrons of the commercial property have repeatedly climbed over the existing hogwire fence onto
the adjacent landowner's property. The trespassers have picked fruits from the adjacent
landowner's fruit trees, loitered, trashed and even urinated on his property. Bill No. 360 was
referred to the Planning Department for review and comments,
Bill No. 360 was waived to the Council and considered at its October 16, 1996 meeting. The bill
was referred to the Planning Committee and the Planning Department for review and
investigation
On October 31, 1996, staff from the Planning Department conducted a field inspection and
observed that the existing fence consists of hog wire and a strand of barbed wire at the top
portion of the fence. The height of the existing fence varies from 4 feet to 5-1/2 feet while the
fence post are 6 feet high. The fence has been installed along the eastern boundary to the end of
the developed azea covered by the subject ordinance.
It was felt by the Planning Department that the type and height of the existing fence are sufficient
and comply with the purpose of Condition I and need not be amended.

Based on the above, Your Committee on Planning recommends that Bill No. 360 be filed.
