Your Committee on Planning, to which was referred Bill No. 7 transmitted by Council Member
James Y. Arakaki via Communication No. 19 dated November 6, 1992, relating to
administrative appeals and administrative procedures, reports as follows:
Bill No. 7 amends Chapter 2 of the Hawaii County Code 1983 which would allow any person
aggrieved by any action of the Chief Engineer, Planning Director, or Planning Commission,
except for Geothermal cases, to a hearing before the Board of Appeals as the final arbitrator
before court review.
Bill No. 7 delineates the appeals procedures and codifies the administrative procedures as to the
method on how the Board of Appeals should operate.
Bill No. 7 was deferred at the Planning Committee's December 14, 1992 meeting. Bill No. 7
was referred to the Legislative Auditor for review and update at the Planning Committee's
December 20, 1994 meeting. Anew Bill No. 277 amending the Hawaii County Charter in
relation to the Board of Appeals and Planning Department was considered by the Council but
was not approved.
In view of Council's consideration of the updated legislation to clarify the administrative appeals
and procedures, Your Committee on Planning recommends that Bill No. 7 be filed.
