Your Committee on Planning, to which was referred Bill 370; reports as follows:
Bill 370, transmitted via Communication 1471 from Mayor Harry Kim, dated September 18, 2008;
presents a Change of Zone Request by RAYMOND and JANE OTOMO at Manowaiopae, North
Hilo, Hawaii, TMK: 3-6-008:002.
Bill 370 seeks to amend Section 25-8-21 (Laupahoehoe-Ninole Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code 1983 (2005 Edition), by changing the District
Classification from Single Family Residential - 15,000 square feet (RS-15) to Single Family
Residential - 10,000 square feet (RS-10) at Manowaiopae, North Hilo, Hawaii.
Communication 1471 reports that the Hawaii County Planning Commission, as required by Chapter 4,
Sec. 6-4.3(C), Hawaii County Charter, considered the above request on September 4, 2008. The
Commission concurred with the Planning Director's reasons for recommending a favorable
consideration of this matter. Communication 1471 transmits the following findings and
recommendations:
The subject .property is located on the south side of Puualaea Homestead Road, near the
intersection with Spencer Road, in Manowaiopae Homestead, North Hilo, Hawaii.
Z. Applicants are requesting a change of zone for approximately 22,366 squaze feet of land and
subdivide the property into two lots. Applicants intend to continue to own one of the lots and
the other lot will be conveyed to their son after a new single-family dwelling is constructed.
Access to the site is from Puualaea Homestead Road, which is a County owned roadway with a
40-foot right-of--way. Upon subdivision, access to the rear lot would be over a 15-foot wide
easement along the northern property boundary.
4. County water is available to the site and all essential utilities (electricity, telephone and cable)
are also available.

5. With respect to wastewater, the existing single-family dwelling utilizes a cesspool and the
proposed dwelling will use a septic system meeting with approval of the Department of Heath.
The change of zone request conforms to the goals, policies and standazds of the General Plan
Economic and Land Use Elements.
• The Land Use Pattern Allocation Guide (LUPAG) Map designates this area as Low Density
Urban, which reflects uses that are single-family residential in chazacter.
• The project site is located within Zone "X", area determined to be outside the 500-year
floodplain.
• The Change of Zone request is not contrary to Chapter 205A, Hawaii Revised Statutes
relating to Coastal Zone Management as the subject property is located approximately a
quarter mile from the shoreline and will not be impacted by coastal hazard and beach
erosion. The shoreline in this area is chazacterized by high sea cliffs.
• The property has been in residential use for thirty yeazs and therefore it is unlikely that
valuable habitat exists for native terrestrial species. There is no evidence of any traditional
and customary native Hawaiian rights being practiced on the site, nor existence of any
known valued cultural, historical or native resources in the area.
At the October 7, 2008 Committee on Planning meeting, there was no public testimony presented.
Planning Committee Chair Pilago noted that Mrs. Otomo had called earlier and advised staff that they
were unable to attend.
Planning Director Yuen explained that this application represents a small rezoning in Laupahoehoe
that will create atwo-lot subdivision for the Otomo family. Mr. Yuen stated the lots have adequate
water, utilities and roads and that with the conditions imposed, the Department supports the rezoning
request.
Councilmember Yagong noted that the applicants are old school people who want to pass a piece of
family-owned property on to their son and that this is the kind of applications the Council should
support.
Your Committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of the Change of Zone request.
