RESOLUTION NO. 13 09
RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A
NINETY-NINE YEAR LEASE WITH THE CATHOLIC CHARITIES HOUSING
DEVELOPMENT CORPORATION FOR THE PURPOSE OF DEVELOPMENT AND
CONSTRUCTION OF TRANSITIONAL AND AFFORDABLE RENTAL HOUSING AT A
SET LEASE RENTAL AMOUNT OF TEN DOLLARS PER YEAR.
WHEREAS, the Office of Housing and Community Development
("OHCD") has made several attempts over the last 15 years to
develop a comprehensive housing program to serve homeless
persons in West Hawai i; and
WHEREAS, the County of Hawaii ("County") secured the
parcel, identified as Tax Map Key 3/7-3-009:055 (the
"Property"), for the purpose of providing housing to the
homeless; and
WHEREAS, the proposed Kaloko Housing Program ("Program")
will function in collaboration with The Friendly Place (a
daytime service center) and the West Hawaii Emergency Housing
Program (an overnight housing program for individuals); and
WHEREAS, Chapter 2, Article 19, Section 2-120(a)(2),
Hawaii County Code, as amended, provides that the County
Council may direct the Finance Director to negotiate the
disposition of real property by lease to non-profit
organizations at such rentals and on such terms and conditions
as deemed proper without notice or appraisal; and
WHEREAS, the OHCD has determined that Catholic Charities
Housing Development Corporation (CCHDC) is a qualified
non-profit housing developer; and
WHEREAS, the CCHDC proposes
transitional housing units and 30
Property (the "Project"); and
o construct at least 24
affordable rental units on the
WHEREAS, the construction of the Project and operation of
the Program will increase housing opportunities for homeless and
low-income families in West Hawai i.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the Finance Director is hereby authorized to
negotiate a ninety-nine (99) year lease with the CCHDC for the
purpose of planning, developing, and constructing the Project
and operating the Program, and for ancillary uses, at a set
lease rental amount of ten dollars ($10.00) per year.
BE IT FURTHER RESOLVED, that the Mayor of the County of
Hawaii or his duly authorized representative is hereby
authorized to execute the lease agreement and any other
documents required to induce financing entities to provide
funding for development of the Project and ancillary components.
BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to the Office of the Mayor, the Department of
Finance, and the Office of Housing and Community Development.
