SUBJECT: An Ordinance to Amend Chapter 25, Article 2, Division 7, Section 25-2-71,
Hawaii County Code 1983 (2005 Edition, as Amended), Relating to the
Zoning Code
The passage of Ordinance No. 08-155 inadvertently amended the Hawaii County Code,
subsection 25-2-71(a). Ordinance No. 08-155 created provisions to allow agricultural
tourism operations on lands with certain zoning designations.
The sole purpose of the attached bill is to rectify the unintentional alteration of the
affected subsection of our Zoning Code.
As this is a "housekeeping" matter, I am requesting that this be waived from the Planning
Committee.
A representative of the Legislative Research Branch will be available at the Council
meeting to discuss this matter and answer any questions.

RE: Bill No. 9 To Amend Section 25-2-71(a), Hawaii County Code; Reinstating Code
Language Inadvertently Amended by the Passage of Ordinance 08-155.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Planning Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval be granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Planning Committee
for placement on its future agenda.
