Dear Councilmember Ford,
It is my considered opinion that the amendments provided to Chapter 10, Erosion and Sedimentation
Control, by the Department of Public Works are inadequate and have gross inconsistencies.
It appears to have been written without consideration of the various Community Development Plans and
without specifically addressing the requirements as specified in the Hokulia settlement:
I further believe that it is entirely proper for this Chapter to address certain flood issues as they relate to
permits issued by the Department of Public works. One cannot decouple operations into separate
chapters that are inextricably linked to development.

Finally, I do not believe that it will take a very long time to create a working document that can be
presented to Council. The worst case scenario would be to wait for all CDPs to be provided with some
realistic endpoint on the order of a few months if those documents are not completed.
