SUBJECT: Resolution requesting the Legislature of the State of Hawaii to Enact a Bill to
Establish a Pilot Program for Vote by Mail for all Federal, State and County
Primary, General, and Special Elections in the County of Hawaii, and to Make an
Appropriation for this Pilot Program.
Attached is a resolution for Vote By Mail Pilot Program in Hawaii County. I would like this
matter waived from the Committee on Public Works & Intergovernmental Relations, and placed
on the Council agenda for January 7, 2009 due to the need to get the packet to the Hawaii State
Legislature expeditiously. I estimate one-hour discussion plus thirty-minute public testimonies.

SUBJECT: Resolution Requesting the Legislature of the State of Hawaii to Enact a Bill to
Establish a Pilot Program for Vote by Mail for all Federal, State and County
Primary, General, and Special Elections in the County of Hawaii, and to Make an
Appropriation for this Pilot Program.
Attached is a proposed bill (Exhibit A), Absentee Ballot Statistics (Exhibit B), and the current
State of Oregon "Vote By Mail Procedures Manual" (Exhibit C) to be sent to the Hawaii State
Legislature for Vote By Mail (VBM) Pilot Program in Hawaii County. I would like this
communication and these associated exhibits to be placed with the VBM resolution on the
Council agenda for January 7, 2009.
In 2005, several Senate and House bills were produced at the State level to initiate a state-wide
Vote By Mail program. All of these bills either died or were killed. My proposed bill (Exhibit
A) was designed by using previous Senate Bill (SB) 642 as the basic state legislation for a
Hawaii County VBM Pilot Program. SB 642 contained many of the issues that the Office of
Elections and I decided needed to be addressed in State legislation for the VBM Pilot Program. I
also extracted additional issues from the current State of Oregon "Vote By Mail Procedures
Mannar' (Exhibit Q. In many instances, I took information verbatim from the manual. In other
cases, I adapted the process to meet the needs of the County of Hawaii Office of Elections. In
using information, quotes, and processes from any person or manual, I had previously received
written permission from the Oregon Secretary of State, Bill Bradbury, to use his statements, the
manual, or any other information from the Oregon State website whether verbatim or altered.
Absentee Ballot Statistics (Exhibit B), was compiled from data located on the State of Hawaii `s
Elections website and information provided by the County of Hawaii Office of Elections data on
the 1988-2008 elections.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai'i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Public Works & Intergovernmental Relations to the full Council
for immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, I understand the
matter shall be referred to the Committee on Public Works & Intergovernmental Relations for
placement on its future agenda.
