A RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTIES BY
EMINENT DOMAIN, BEING PORTIONS OF TAX MAP KEYS: (3)4-4-009:003 AND 008,
SITUATE AT PAPALELE, IN THE DISTRICT OF HAMAKUA, COUNTY AND STATE OF
HAWAII, FOR THE KALOPA SAND GULCH BYPASS ROAD PROJECT, FROM
KAMEHAMEHA SCHOOLS-BISHOP ESTATE.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Kamehameha Schools-Bishop Estate is the owner of real properties
situate at Papalele, in the District of Hamakua, Hawaii, identified as Tax Map
Keys: (3)4-4-009:003 and 008; and
WHEREAS, the County will be doing roadway improvements in the Kalopa Sand Gulch
area; and
WHEREAS, these roadway improvements will require the acquisition by the County of
portions of Bishop Estate's properties, identified as follows:
Parcel 2 0.556 acres TMK: (3)4-4-009:003 (por.)
Parcel 3 0.408 acres TMK: (3)4-4-009:003 (por.)
Pazce14 0.807 acres TMK: (3)4-4-009:008 (por.)
and more specifically delineated on the attached maps; and
WHEREAS, these roadway improvements will provide a regional benefit for a public
purpose and use which benefits the County of Hawaii; and
WHEREAS, it is necessary for the County of Hawaii to acquire the above-described
portions of real properties, requiring that the County of Hawaii invoke its condemnation powers,
to complete the roadway improvements; and
WHEREAS, Section 101-13 of the Hawaii Revised Statutes requires that a
condemnation action by the County of Hawaii must be authorized by a resolution of the County
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it is necessary for the public use and purpose, to wit: improving roadway in the
Kalopa Sand Gulch area in the District of Hamakua, County and State of Hawaii, to take,
acquire and condemn portions of those certain private properties identified as follows and
delineated on the attached maps:
Parcel 2 0.556 acres TMK: (3)4-4-009:003 (por.)
Parcel 3 0.408 acres TMK: (3)4-4-009:003 (por.)
Parcel 4 0.807 acres TMK: (3)4-4-009:008 (por.)
BE IT FURTHER RESOLVED that the Corporation Counsel of the County of Hawaii
be and is hereby authorized and empowered to initiate proceedings in eminent domain, as
provided by law, for the taking, acquisition and condemnation of the aforesaid private properties.
BE IT FURTHER RESOLVED that in the process of said proceedings in eminent
domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms
of settlement in accordance with Section 2-10, Hawaii County Code, and the approval of the
court before which such proceedings aze prosecuted.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of
Hawaii; (2) Warren H.W. Lee, Director of Public Works; (3) Assistant Corporation Counsel
Gerald Takase; and (4) Terry Knabusch, Kamehameha Schools-Bishop Estate, P.O. Box 495,
Pa`auilo, Hawaii 96776.
