Your Committee on Finance, to which was referred Resolution No. 274-98, reports as follows:
Resolution No. 274-98, transmitted by Council Member AI Smith, via Communication No. 854,
dated May 14, 1998, requests the support of the National Association of Counties' (NACo)
position opposing federal preemption of local zoning authority over satellite broadcast and
cellular phone antennas.
Currently, the Federal Communications Commission and Congress is entertaining a proposal that
would preempt local zoning authority over the location of both satellite broadcast antennas and
cellular phone towers. NACo has been in opposition to this proposal and has taken a position
recognizing that local governments are the closest to the people and, accordingly, are more
knowledgeable about and accountable for the consequences of land use decisions. NACo further
believes that local governments aze also sophisticated enough to balance competing interests
when making their zoning decisions.
This matter is also being considered as a position of the Hawaii State Association of Counties
(HSAC).
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 2'~4-98
and recommends its adoption.
