Your Committee on Finance, to which was referred Bill No. 229, reports as follows:
Bill No. 229, transmitted by Council Member John Ray, via Communication No. 816, dated
Apri122, 1998, initiates a charter amendment to Section 3-2, Article III, Hawaii County Chazter
relating to composition and terms of the Hawaii County Council.
In the 1996 general election, the electorate of Hawaii County voted to enact an amendment to the
Hawaii County Charter to establish term limits of Council Members not to exceed four
consecutive two-yeaz terms. Subsequently, Bill No. 229 proposes to initiate a charter
amendment to establish the term limits of Council Members not to exceed two consecutive four-
year terms.
For further clarification, Section 3 of Bill No. 229 states,
To honor the spirit and intent of the 1996 term limitation Chazter amendment, this
ordinance establishing conversion to four-year terms of office beginning in the year 2000
determines that any council member elected in 1996 and re-elected to office in the 1998
and 2000 general elections shall be eligible to serve consecutive terms of office until
2004. This ordinance finds that incumbent council members elected in 1996 may serve
two (2) two-yeaz terms until the yeaz 2000, and one (1) four-year term until the year
2004.
Pursuant to Article XV, Section 15-1(a), Hawaii County Charter, amendments or revisions of
this charter may be initiated by ordinance of the council adopted after three readings on sepazate
days and passed by the affirmative vote oftwo-thirds of the entire membership.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 229 ana
recommends it pass first reading.
