Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 27, regazding Bill 5, reports as follows:
Bi115, transmitted by Director of Public Works, Bruce McClure, via Communication No. 27,
dated November 17, 2008 amends Ordinance No. 08-64, which amended Chapter 24 of the
Hawaii County Code 1983 (2005 edition, as amended), is amended to read as follows:
"SECTION 5. This ordinance becomes effective after the new section of Haleki`i
Street is dedicated and accepted by the County of Hawaii or the land owner grants an
easement to the County of Hawaii for the numoses of carrvine out the requirements of
this ordinance [and] the new section of Haleki`i Street is properly posted with signage
for one-way traffic restriction, and after the following mitigative measures are
implemented and accepted by the County of Hawaii.
There was no testimony from the public on this proposed bill.
Committee Chair Brenda J. Ford relinquished her seat to Committee Vice Chair Kelly
Greenwell.
Public Works Director Warren Lee and Traffic Division Chief Ron Thiel appeazed before your
Committee. Mr. Thiel commented that this recommendation was submitted by former Public
Works Director Bruce McClure. As submitted by the November 17, 2008 transmittal, the
Haleki`i Extension, approximately 4,400 feet in length, not only provides access to Hokulia but
also provides access to 52 proposed lots in Phase 3 East. The developer has not started
construction in Phase 3. In order to open the Bypass for evening one-way traffic, the County of
Hawaii will operate under a grant of easement from the landowner.
Mr. Thiel provided the Committee members an update on the mitigative measures in Ordinance
No. 08-64 that have been implemented, as well as the others projected to be completed in

February, 2009. Mr. Lee stated the Kona base yard crew had been briefed on the priorities
related to this amendment.
Hokulia's attorney, Mr. Michael Matsukawa clarified questions regarding Hokulia's structure
and updated Committee members on the current oversight of 1250 Oceanside.
Ms. Ford expressed concerned regarding this proposed bill and the impact of Hokulia's financial
situation and the shift of controlling interest in Hokulia's assets to an international financial
bank. Further, Ms. Ford stated her concern about certain legalities of easement from this
landowner's local management (1250 Oceanside) to enter into a contract with the County of
Hawaii. Deputy Corporation Counsel Torigoe commented that the discussion is on-going with
the landowner but confirmed receipt of a letter on behalf of the financial institution that
1250 Oceanside has the legal authority to enter into a contract with the County.
For informational purposes, Council member Ford voted kanalua twice.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose
and intent of Bi115, and recommends it pass first reading.
