RESOLUTION NO. 5 S 97
RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOTS WITHIN W.H.
SHIPMAN MUTUAL SELF-HELP SUBDIVISION, FROM HAWAII ISLAND
COMMUNITY DEVELOPMENT CORPORATION, TAX MAP KEY (3)1-6-142:077, TO
THE COUNTY OF HAWAII.
WHEREAS, Hawaii Island Community Development Corporation, a
Hawaii corporation, is the developer of the W.H. Shipman. Mutual
Self-Help Subdivision, an~ the owner of those certain roadway
lots located in Keaau, Puna, Hawaii, specifically identified as
Tax Map Key (3)1-6-142:077, being more particularly described in
Exhibit A and shown on Exhibit B, both of which are attached
hereto; and
WHEREAS, Hawaii Island Community Development Corporation has
constructed all subdivision improvements as required for final
subdivision approval; and
WHEREAS, Hawaii Island Community Development Corporation has
received approval from the County of Hawaii's Department of
Public Works, Department of Water Supply and the Planning
Department for the improvements made to the subject properties,
and are desirous of dedicating the subject parcels to the County
of Hawaii for road and drainage purposes; and
WHEREAS, the subject road and drainage improvements have
been completed according to County of Hawaii standards and are in
acceptable condition for dedication; and
WHEREAS, Section 23-10 of the Hawaii County Code requires
that the acceptance of such road and drainage improvements be in
compliance with Chapter 23 of the subdivision code; and

WHEREAS, Article XIII, Section 13-12 of the Hawaii County
Charter, provides that the Council may accept gifts which include
the dedication of land on behalf of the County of Hawaii; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with Article XIII, Section 13-12 of the
Hawaii County Charter, and Section 23-10 of the Hawaii County
Code, that the County of Hawaii accepts the dedication deed for
real properties identified as Tax Map Key (3)1-6-142:077 for road
and drainage purposes.
