<br />" <br />I <br />I <br /> <br />, <br /> <br />, <br /> <br />OYv~4JSLiJ:=- <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. <br /> <br />70 <br /> <br />97 <br /> <br />RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTIES FOR <br />PERMANENT EASEMENT PURPOSES FOR THE PAUKAA SEWER SYSTEM, LOCATED <br />AT PAUKAA, DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> <br />I. <br /> <br />That it is necessary for the pUblic use and purpose, to <br /> <br />wit: the improvement, construction, operation and maintenance of <br /> <br />the Paukaa sewer system and adjacent lands for sewer system <br /> <br />disposal in connection with the paukaa sewer system, situate at <br /> <br />Paukaa, District of South Hilo, Island, County and State of <br /> <br />Hawaii, to take, acquire and condemn certain private properties <br /> <br />for permanent easement purposes with all improvements thereon and <br /> <br />appurtenances thereunto belonging, free and clear of all liens and <br /> <br />encumbrances, and to that end and for these purposes the <br /> <br />Corporation Counsel of the County of Hawaii be and is hereby <br /> <br />authorized and empowered to initiate proceedings in eminent <br /> <br />domain, as provided:by Chapter 101; Hawaii Revised Statutes, as <br />amended, for the taking, acquisition and condemnat~on of the <br />private properties described in Exhibits "A" throu~h US" and shown <br /> <br />on location plans marked Exhibits "1" through "12," all attached <br /> <br />hereto and made a part hereof, together with any adjacent private <br /> <br />properties necessary for temporary construction purposes, <br /> <br />including but not limited to temporary easements for construction <br /> <br />and operations, storage and disposal areas. <br />
