<br />r <br /> <br />- <br /> <br />. <br /> <br />~'!(~ <br /> <br />.' <br /> <br />COUNTY OF HAWAII' STATE OF HAWAII <br /> <br />RESOLUTION NO. . 70 97 <br />Draft 2 <br /> <br />RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTIES <br />FOR PERMANENT EASEMENT PURPOSES FOR THE P AUKAA SEWER <br />SYSTEM, LOCATED AT PAUKAA, DISTRICT OF SOUTH HILO, COUNTY AND <br />STATE OF HAWAII <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII <br /> <br />I. <br /> <br />That it is necessary for the public use and purpose, to wit the improvement, <br /> <br />construction, operation and maintenance of the Paukaa sewer system and adjacent lands <br /> <br />for sewer system disposal in connection with the Paukaa sewer system, situate at Paukaa, <br /> <br />District of South Hilo, Island, County and State of Hawaii, to take, acquire and condemn <br /> <br />certain private properties for permanent easement purposes with all improvements <br /> <br />thereon and appurtenances thereunto belonging, free and clear of all liens and <br /> <br />encumbrances, and to that end and for these purposes the Corporation Counsel of the <br /> <br />County of Hawaii be and is hereby authorized and empowered to initiate proceedings in <br /> <br />eminent domain, as provided by Chapter 101, Hawaii Revised Statutes, as amended, for <br /> <br />the taking, acquisition and condemnation of the private properties described in <br /> <br />Exhibits "A" through "s" and shown on location plans marked Exhibits "I" through <br /> <br />"12," all attached hereto and made a part hereof, together with any adjacent private <br /> <br />properties necessary for temporary construction purposes, including but not limited to <br /> <br />temporary easements for construction and operations, storage and disposal areas <br />
