Subject: Ordinance No. OS-153, Condition 2N (Annual Progress Report)

The following is an annual progress report, as required by Condition 2N of the County of
Hawaii Ordinance No. OS-153.
The State of Hawaii, Department of Land and Natural Resources (DLNR) is the owner of the
above-referenced parcel. County of Hawaii Ordinance No. OS-153, enacted on December 2,
2005 (the Ordinance), amended the zoning district classification for the subject property from
Open (O) to Industrial-Commercial (MCX-la).
The Ordinance imposes several conditions regarding the development of the property. As
explained in the rezoning application, DLNR will not be the entity that undertakes the
development of the site. Instead, it has always been DLNR's intent to offer along-term
ground lease for the property by public auction, with the successful bidder undertaking the
development of the property. The ground lease will be subject to the terms and conditions of
the Ordinance and will require the successful bidder (lessee) to comply with such terms and
conditions.
DLNR conducted a public auction fora 65-year ground lease on March 27, 2008. The
successful bidder for the property was Kawaihae Restaurant LLC (KRLLC), which is
performing its due diligence prior to submitting the required SMA application for the
property. KRLLC is currently working with the Department of Water Supply and the State
Department of Transportation on obtaining the necessary permits for water and to access the
property respectively.
Since the ground lease will not be issued until the successful bidder obtains the necessary
SMA approval from the County of Hawaii, there have not yet been anyFdevelopmenta..,,e,.
