Subject: A Bill for an Ordinance Amending Chapter 19, Article 11, Sections 19-90, 19-75,
and 19-89.5, Hawaii County Code 1983 (2005 Edition, as amended), Relating to
Real Property Tax -Determination of Rates.
Currently, the Council's intention to increase or decrease the real property tax rates (RPTR)
requires a public hearing. A public hearing notice is published in the newspaper at least 10 days
prior to the public hearing (approximate time to complete is 17 days). The Council must
reconvene within three weeks following the public hearing and a notice of re-advertisement
stating the new rates and date, time and place of the Council meeting must be published in the
newspaper (approximate time to complete is 14 days). If the resolution fixing the new RPTR is
not adopted within three weeks after the public hearing, the process must start over again with a
new public hearing. The total time to complete this task is between 31-to 38 days. Any error,
proposed increase or decrease in the RPTR, or other amendment to the resolution compels the
council to start the process over from the beginning. The usual start date for the entire process is
May 5 (Mayor's amended budget submitted to council). The completion date for this current
fiscal cycle is June 2, 2009, though we have until June 20, 2009.
Enclosed is a bill amending chapter 19, article 11, sections 19-9Q 19-75, and 19-89.5, Hawaii
County Code 1983 (2005 Edition, as amended), relating to Real Property Tax, Determination of
Rates.
The proposed amendments are as follows:
1. Paragraph 19-90(b)(1) requires notification in two newspapers of general circulation
rather than one and also deletes the 10 day minimum notice of the RPTR public hearing.
2. Paragraph 19-90(b)(2), which requires the council to re-advertize and reconvene within
three weeks of the public hearing is deleted in its entirety. Paragraph 19-90(b)(2) is
replaced with those provisions currently found in subsection 19-90(c).
3. Paragraph 19-90(b)(3), which requires compliance of paragraph 19-90(b)(1) and (2)
should the Council require further increase or decrease of the RPTR is deleted in its

entirety. This text is replaced with the requirement that new tax rates shall be noticed in
two newspapers of general circulation.
4. Subsection 19-90(c), which discloses the method to set the RPTR is deleted in its
entirety. This determination is now reflected above in number 2, paragraph 19-90(b)(2).
5. Paragraph 19-90(f), which disclosed the validity, directory and mandatory concerns is
deleted in its entirety.
6. Amend sections 19-'IS(b) and 19-89.5 so that current references to section 19-90(g)
remain linked to the renumbered section 19-90(e).
