COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO.~ RESOLUTION OF THE COUNTY COUNCIL OF THE COUNTY OF HAWAI'I AUTHORIZING THE EXEMPTION OF THE PROPOSED KEONELEHUA HEIGHTS AFFORDABLE HOUSING PROJECT SITE FROM CERTAIN ZONING, SUBDIVISION AND ROADWAY CODES AND OTHER REQUIREMENTS, PURSUANT TO CHAPTERS 201E-201 AND 201E-210 OF THE HAWAI'I REVISED STATUTES. WHEREAS, Nohona Partners (hereinafter "NP") has been working to develop an affordable housing project (hereinafter "Keonelehua Heightsll) on land at Maka'ula, North Kona, Hawai'i, and identified as TMK: 7-3-03: Portion 9, to provide decent, safe and sanitary housing to qualified individuals of the County of Hawai'i (hereinafter "County"); and WHEREAS, the Office of Housing and Community Development (hereinafter "OHCD") has been working with NP to develop this project; and WHEREAS, the County and NP mutually desire to develop affordable single family lots for sale to families with income levels of 140 percent (140%) and below the median family income for the County of Hawai'i; and WHEREAS, the OHCD has determined that (1) NP is an acceptable and eligible developer in satisfaction of the requirements of Chapter 201E of the Hawai'i Revised. Statutes; 'and (2) the Maka'ula area is a good and proper choice for housing development and construction; and WHEREAS, the County and NP will be entering into an Agreement to develop the Keonelehua Heights affordable housing project; and WHEREAS, NP has agreed to contribute approximately $37,500 to pay for the costs of related recreation improvements; and WHEREAS, the preliminary subdivision plans and roadway plans submitted for the Keonelehua Heights affordable housing project, attached hereto as "Exhibit A," amends the preliminary subdivision plans that were previously adopted pursuant to Resolution 36-97 (Draft 2); and WHEREAS, to enable, -the Keonelehua. Heights affordable. housing project to remain affordable, as defined by the Interim-AffQrdable Housing Policy for the County of Hawai'i, the OHCD is proposing to utilize Chapter 201E-210 of the Hawai'i Revised Statutes, which allows certain housing projects to be exempt from certain laws and rules, provided the County Council approves; and WHEREAS, the Keonelehua Heights affordable housing project will promote the goals contained in Chapter 201E, 46-15.1, of the Hawai'i Revised Statutes, and in Chapter 2, Article 13, of the Hawai'i County Code. . . NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I, that preliminary subdivision plans and roadway plans for the Keonelehua Heights affordable housing project site are hereby approved as attached hereto as "Exhibit A." BE IT FURTHER RESOLVED, that upon compliance with Chapter 25, Article 30, of the Subdivision Code and/or code requirements exempted pursuant to provisions of Chapter 201E-210 of the Hawai'i Revised Statutes, the preliminary subdivision plans for the Keonelehua Heights affordable housing project site shall be granted final subdivision approval. BE IT FURTHER RESOLVED, that pursuant to provisions of Chapter 201E-210(a) (3) (C) of the Hawai'i Revised Statutes, that the Mayor of the County of Hawai'i or his duly authorized representative shall be the responsible County official who will certify maps and plans of lands connected with the Keonelehua Heights affordable housing project as having complied with applicable laws and ordinances relating to the subdivision of lands. BE IT FURTHER RESOLVED, that Nohona Partners has agreed to contribute $37,500 to pay for related recreational facilities before the first lot is sold. BE IT FURTHER RESOLVED, that this resolution supersedes Resolution 36-97 (Draft 2). BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to Nohona Partners, the Planning Director for the County of Hawai'i and the Office of Housing and Community Development. Pursuant to Chapter 201E-210, Hawai'i Revised Statutes, the following exemptions from code requirements and standards, as established by Public Works, are requested as follows: 1. Zoning Code: County - Agriculture Exemption: RS-10, Residential Single Family with a minimum lot size of 10,000 square feet on lands zoned - Agriculture. 2. Subdivision Code: Exemption: That the typical private roadway standards be as shown on the plan attached as Exhibit "A." 3. Subdivision Code: Exemption: That the number of lots that access a private dead end roadway standards be as shown on the plan attached as Exhibit "A." 4. Land Use Boundary Amendments: SLUC - Agriculture Exemption: Urban use on State Land Use Designation - Agriculture lands. Exemption from Hawai'i Revised Statutes, Sections 205-3.1(c) and 205-3.1(d), district boundary amendments involving land areas of 15 acres or less, and Hawai'i County Code, Chapter 28, State Land Use District Boundary Amendment Procedures. 0684H.EST EXHIBIT "A"
