COUNTY OF HAWAII ':STATE OF HAWAII
RESOLUTION
RESOLUTION REQUESTING THE GOVERNOR AND THE LEGISLATURE TO CONVENE A SPECIAL
SESSION TO RESOLVE THE PRIV A TIZA TION ISSUE
WHEREAS, for many years, the County of Hawaii and numerous other government agencies in the State
have had contracts with private parties to provide services to the public; and
WHEREAS, this system for providing services to the public has been put in turmoil because of the recent
decision in Konno v. County of Hawaii, which ruled that government cannot privatize services without the express
consent of the Legislature; and
WHEREAS, the Konno decision has spawned different interpretations among the various government
agencies, has created confusion for private service providers, and has resulted in extensive litigation in the various
Courts.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA WAIl that it
requests the Governor and the Legislature to immediately convene a special session of the Legislature to resolve the
privatization issue.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted to Governor Benjamin
Cayetano, Senate President Norman Mizuguchi, House Speaker Joseph Souki, Mayor Stephen K. Yamashiro and
the Mayors and Council Chairpersons of the other counties.
