RESOLUTION NO. 116 97
(DRAFT 2)
RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO AN
AGREEMENT WITH THE UNITED STATES OF AMERICA, PURSUANT TO HRS 46-7,
FOR MARIJUANA ERADICATION GRANT.
WHEREAS, the United States of America through the U.S. Department of Justice
Drug Enforcement Administration, is desirous of providing funding for expenses for the
eradication and suppression of illicit marijuana; and
WHEREAS, the Hawaii County Police Department is ready and willing to proceed
with its obligations for the Marijuana Eradication Program, and
WHEREAS, pursuant to Section 46-7 of the Hawaii Revised Statutes, the Federal
government may enter into agreements with the Council of the County of Hawaii respecting
the furnishing, expenditure or receipt of funds or other assistance;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAW All that it requires as conditions of County Project Number 97-39 and its
accompanying Agreement that (1) some of the funds be expended on a program review of the
marijuana eradication program, which shall be submitted to the Council within 90 days of the
grant's termination or sooner, and (2) no funds shall be used on aerial herbicide and chemical
spraying of marijuana plants.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAW All
that the Honorable Stephen K. Yamashiro is hereby authorized and designated to sign in the
name of the County Project Number 97-39, which will effectuate these purposes.

BE IT FURTHER RESOLVED that the County Clerk is hereby directed to forward
copies of this Resolution to said Mayor Yamashiro, the Chief of Police, and'any other
interested governmental agencies.
