<br />..... <br /> <br />''- <br /> <br />. <br /> <br />) <br /> <br />. <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />I. <br /> <br />RESOLUTION NO. 140 97 <br />(DRAFT 2) <br /> <br />RESOLUTION ADOPTING A PORTION OF LOT 6213, HAWAI'IAN ACRES, PUNA, <br />AS A COUNTY ROAD. <br /> <br />WHEREAS, that portion of Lot 6213 which is described in the <br /> <br />attached Exhibit I, which is located in Hawai'ian Acres <br /> <br />subdivision in Puna, County of Hawaii, comprises the main route <br /> <br />through the Hawai'ian Acres Subdivision; and <br /> <br />WHEREAS, that portion of Lot 6213 in Hawai'ian Acres, by <br /> <br />connecting with Ainaloa Boulevard, is an important component of <br /> <br />the proposed "Puna Emergency Road"; and <br /> <br />WHEREAS, the title to that portion of Lot 6213 is jointly <br />held by the owners of approximately 3,900 lots within the <br /> <br />subdivision, each with an undivided interest; and <br /> <br />WHEREAS, no person has exercised any act of ownership over <br /> <br />the road for more than five (5) years; and <br />WHEREAS, the road is not constructed and maintained up to <br /> <br />County of Hawaii standards at the present time; and <br /> <br />WHEREAS, Hawaii Revised Statutes, Section 264-1(c)(2) <br /> <br />provides that where no act of ownership has been exercised over <br /> <br />the road, way or lane for more than five (5) years and, in the <br /> <br />case of a County highway, where the legislative body has accepted <br /> <br />or adopted the same by resolution, the road, way, or lane shall <br /> <br />become a County highway. <br />
