RESOLUTION NO. 140 97
(DRAFT 2)
RESOLUTION ADOPTING A PORTION OF LOT 6213, HAWAI'IAN ACRES, PUNA,
AS A COUNTY ROAD.
WHEREAS, that portion of Lot 6213 which is described in the
attached Exhibit I, which is located in Hawai'ian Acres
subdivision in Puna, County of Hawaii, comprises the main route
through the Hawai'ian Acres Subdivision; and
WHEREAS, that portion of Lot 6213 in Hawai'ian Acres, by
connecting with Ainaloa Boulevard, is an important component of
the proposed "Puna Emergency Road"; and
WHEREAS, the title to that portion of Lot 6213 is jointly
held by the owners of approximately 3,900 lots within the
subdivision, each with an undivided interest; and
WHEREAS, no person has exercised any act of ownership over
the road for more than five (5) years; and
WHEREAS, the road is not constructed and maintained up to
County of Hawaii standards at the present time; and
WHEREAS, Hawaii Revised Statutes, Section 264-1(c)(2)
provides that where no act of ownership has been exercised over
the road, way or lane for more than five (5) years and, in the
case of a County highway, where the legislative body has accepted
or adopted the same by resolution, the road, way, or lane shall
become a County highway.

BE IT THEREFORE RESOLVED, by the Council of the County of
Hawaii, that that portion of Lot.6213 in Hawai'ian Acres
Subdivision, is hereby adopted as a County Highway, pursuant to
Hawaii Revised Statutes, Section 264-1(c)(2); and
BE IT FURTHER RESOLVED that the Clerk file a certified copy
of this resolution with the State Bureau of Conveyances and
provide further copies to the Mayor, the Chief Engineer, and the
Director of Finance of the County of Hawaii.
