RESOLUTION NO. 141 97
(DRAFT 2)
AUTHORIZATION FOR COUNTY OF HAWAII TO PARTICIPATE IN THE
DEMONSTRATION PAPAYA QUARANTINE PROGRAM.
WHEREAS, the State Department of Agriculture ("DOA"), the College of Tropical Agriculture
and Human Resources ("CT AHR") and Research Corporation of the University of Hawaii
("RCUH") desire to implement a demonstration quarantine program in Puna, Hawaii, and has
invited the County of Hawaii to be a participant; and
WHEREAS, the role of the County of Hawaii will be to lease lands from Kamehameha Schools
Bishop Estate for purposes of allowing permittees to plant papaya pursuant to pre-approved crop
development plans and to implement disease control measures; and
WHEREAS, DOA and the Papaya Administrative Committee, with County observing, will select
and assist in assigning lands to permittees in a fair and impartial manner; and
WHEREAS, DOA, with CT AHR assisting, will develop project management protocols and
implement the demonstration "Quarantine Program" project in accordance with conditions
contained in the management protocols; and
WHEREAS, RCUH will act as the fiscal agent for the County and will be responsible to the
County for collection of rents, disbursement of project expenses and accountability of all project
income and expenses; and
WHEREAS, RCUH, in its capacity as fiscal agent for the County, shall be responsible for le~se
payments to Kamehameha Schools Bishop Estate under the terms of the County of Hawaii's
lease agreement with Kamehameha Schools Bishop Estate; and
WHEREAS, pursuant to Section 46-7, Hawaii Revised Statutes, the County, with the consent of
the Council, may enter into agreements with any public bodies respecting action to be taken to
furnish, expend and receive funds or other assistance in connection with projects to be
undertaken; and
WHEREAS, pursuant to Section 10-11, Hawaii County Charter, any contract, lease or other
obligation requiring the payment of funds from the appropriation of more than one fiscal year
shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HA WAIl that it authorizes the County Administration to participate in the demonstration
"Quarantine Program".
BE IT FURTHER RESOLVED that the Administration is further authorized to enter into a five
year lease with Kamehameha Schools Bishop Estate for lands to be utilized for the "Quarantine
Program".
BE IT FURTHER RESOLVED that the Administration be authorized to enter into a
Memorandum of Agreement with DOA and the University of Hawaii to describe the
responsibilities to be undertaken by each agency to implement the Papaya Quarantine Program.
BE IT FURTHER RESOLVED that the Administration is further authorized to license said lands
to permittees in accordance with the selection process established by the "Quarantine Program".
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the Honorable
Stephen K. Yamashiro, Mayor of the County of Hawaii; Mr. James Nakatani, State Department
of Agriculture; Trustees of Kamehameha Schools Bishop Estate; Mr. Harold Masumoto, RCUH,
and Ms. Diane Quitiquit, Director of Research and Development, County of Hawaii.
