RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MUL TI- YEAR
AGREEMENT WITH HA WAIl ELECTRIC LIGHT COMPANY, INC. FOR THE
KEALAKEHE W ASTEW A TER TREATMENT PLANT.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or
other obligation requiring payment of funds from the appropriations of a later fiscal year or more
than one fiscal year be approved by resolution; and
WHEREAS, by entering into a Rider M, Option B Agreement with HAW All ELECTRIC
LIGHT COMPANY, INC. ("HELCO") for the Kealakehe Wastewater Treatment Plant
("WWTP") facility, the annual electricity cost savings would be approximately $36,420.00 per
year; and
WHEREAS, both a three-year and five-year agreement is required since HELCO is
required to obtain Public Utilities Commission ("PUC") approval for three-year agreements. The
five-year agreement would apply until such time that the PUC approves the three-year
agreement; and
WHEREAS, a sample Rider M Agreement is attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII:
1. That the Mayor is hereby authorized to enter into a multi-year Rider M
Agreement with HELCO for the Kealakehe WWTP.

2. That sufficient funds be budgeted for the appropriate future fiscal years to cover
the anticipated obligation of the County under the Rider M Agreement.
BE IT FURTHER RESOLVED that the Clerk transmit copies of this resolution to the
Department of Finance and the Department of Public Works.

giV> RIDER M AGREEMENT
This agreement covers electric service provided by Hawaii Electric Light Company, Inc.
(HELCO) to County of Hawaii, Division of Sewers, Customer, on HELCO account no.
8600-2207-002 at Kealakehe,North Kona.
Under this Agreement, service will be provided to the customer on Rate Schedule J, and
Rider M, Option B.
All terms of Schedule J will apply except as specifically modified by Rider M. Well testing
and emergency operation will be allowed provided adequate notification is given to
HELCO.
For Rider M, Option B service the Customer intends to curtail the contracted amount of
175 HP during the hours of 5:00 PM to 9:00 PM Monday through Friday.
This agreement shall become effective at the beginning of the first regular billing cycle
following load deferral testing.
