DERNBACH, TAX MAP KEY (3)4-3-15:009 (PORTION), AND FROM JEROME H. MOONEY, TAX MAP KEY (3)1-8-73:065 (PORTION), TO THE COUNTY OF HA WAIl. WHEREAS, Timothy A. Dembach is the owner of real property situated at Paauilo Homesteads, Second Series, District of Hamakua, Island and County of Hawaii, State of Hawaii, specifically Tax Map Key No. (3)4-3-15:009 (portion), consisting of approximately 1,816 square feet or 0.042 acre, more particularly described in Exhibit "A" and delineated on Exhibit "B" attached hereto; and WHEREAS, Jerome H. Mooney, individually and as Trustee under that certain Trust Agreement dated June 29, 1990, is the owner of real property situated in the District of Puna, Island and County of Hawaii, State of Hawaii, specifically Tax Map Key No. (3)1-8-73:65 (portion), consisting of approximately 0.770 acre, more particularly described in Exhibit "C" and delineated on Exhibit "D" attached hereto; and WHEREAS, it is necessary for the County of Hawaii to acquire the above-mentioned real property to complete replacement of the Oshiro Bridge and Kalopa/Aliipali Bridge, Federal Aid Project No. BR-0100(49); and WHEREAS, Timothy A. Dembach and Jerome H. Mooney have graciously donated the above-mentioned real property to the County of Hawaii; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the Council, on behalf of the County of Hawaii, may accept gifts or donations of real property. . . ,. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA WAIl, that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the County of Hawaii accepts the donation of the following: Tax Map Key No. (3)4-3-15:009 (portion), consisting of 1,816 square feet or 0.042 acre, from Timothy A. Dernbach; and Tax Map Key No. (3)1-8-73:065 (portion), consisting of 0.770 acre, from Jerome H. Mooney. BE IT FURTHER RESOLVED that letters of appreciation be sent to Timothy A. Dernbach and Jerome H. Mooney.
