Your Committee on Finance, to which was referred Bill No. 147, reports as follows:
Bill No. 147, transmitted by Council Chair James Arakaki, via Communication No. 521, dated
September 18, 1997, amends Chapter 2 of the Hawaii County Code 1983 (1995 Edition) by
adding a new article relating to the Legislative Branch and its ability to contract for services.
Bill No. 147 proposes to authorize the Council Chair, rather than the Mayor, to execute contracts
on behalf of the Council and the Office of the County Clerk. The execution of the contract shall
be sufficient to obligate the county, subject to approval by the Corporation Counsel and Director
of Finance.
Accompanying the measure was Opinion No. 97-03 from the Corporation Counsel which opines
that this amendment to the County Code is sufficient authority.
Members of Your Committee expressed concerns regarding the logistics of implementing such a
measure, the accountability of issuing contracts and the appropriateness of approving a measure
such as this by ordinance rather than by a Charter amendment that would allow the electorate the
determining vote.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 147' and
recommends it pass first reading.
