RESOLUTION NO. 51 09
RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT A (MAUNALE`O PLACE),
ROAD LOT B (MAUNANANI PLACE) AND ROAD LOT C (MAUNAKEHA WAY), BEING TAX
MAP KEYS: (3) 9-9-010-041, 042 AND 043, SITUATE AT KEAUHOU, DISTRIC"I' OF KA`U,
COUNTY AND STATE OF HAWAII, FROM VOLCANO FAIRWAYS DEVELOPMENT
CORPORATION.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`l.
WHEREAS, VOLCANO FAIRWAYS DEVELOPMENT CORPORATION is the owner of:
(1) Road Lot A (Maunale`o Place), containing an area of 35,606 square feet, more or less, identified as
Tax Map Key: (3) 9-9-010-041 (Exhibit A); (2) Road Lot B (Maunanani Place), containing an area of
37,097 square feet, more or less, identitied as "fax Map Key: (3) 9-9-010-042 (Exhibit B); and Road
Lot C (Maunakeha Way), containing an area of 10,206 square feet, more or less, identitied as Tax Map
Key (3) 9-9-O10-043 (F,xhibit C), situate at Keauhou, in the District of Ka`u, County and State of
Hawaii, as delineated on F.,xhibit D attached hereto; and
WHEREAS, VOLCANO FAIRWAYS DEVELOPMENT CORPORATION has constructed all
subdivision improvements and received final subdivision approval; and
WHF.,REAS, VOLCANO FAIRWAYS DEVELOPMENT CORPORATION is desirous of
dedicating Road Lot A (Maunale`o Place), Road Lot B (Maunanani Place) and Road Lot C
(Maunakeha Way), including all subdivision improvements thereon, to the County of Hawaii for road
and drainage purposes, and the improvements have been inspected and approved by the County of
Hawaii Department of Public Works, Department of Water Supply, and the Planning Department; and
WHEREAS, the subject roads and drainage improvements have been completed according to
County of Hawaii standards, and are in acceptable condition for dedication, and in full compliance
with the provisions of Chapter 23 of the Hawaii County Code; and
WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving
by dedication any streets in any subdivision platted after December 2, 1966 except upon full
compliance with the provisions of Chapter 23; and
WHEREAS, Article XI[l, Section 13-12 ofthe Hawaii County Charter, provides that the
council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAI`1 that it finds the subject subdivision and improvements thereon are in full compliance with
the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable
agencies.
BE IT FURTHER RESOLVED BY "fHG COUNCIL OF THE COUNTY OF HAWAII, in
accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the
Hawaii County Code, that the County of Hawaii accepts the dedication of Road Lot A (Maunale`o
Place), containing an area of 35,606 square feet, more or less, identified as Tax Map
Key: (3) 9-9-010-041 (Exhibit A); (2) Road Lot B (Maunanani Place), containing an area of 37,097
square feet, more or less, identified as Tax Map Key: (3) 9-9-010-042 (Exhibit B); and Road Lot C
(Maunakeha Way), containing an area of 10,206 square feet, more or less, identified as Tax Map
Key (3) 9-9-010-043 (Exhibit C), situate at Keauhou, in the District of Ka`u, County and State of
Hawaii, delineated on Exhibit D attached hereto, including all improvements thereon, for public road
and drainage purposes.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) the Mayor;
(2) the Department of Public Works; (3) Deputy Corporation Counsel Gerald A. Takase; and
(4) Steven S.C. Lim, Esq., Carlsmith Ball, LLP, 121 Waianuenue Avenue, Hilo, Hawaii 96720.
