Re: Amendment to the Hawai'i County Code
Enclosed is a bill for an ordinance amending Chapter 32, Article 2, Section 32-24 of the
Hawai'i County Code 1983 (2005 Edition, as amended) pertaining to the waiver of notice
and hearing by petition. This amendment eliminates a reference to the property appraisal
requirements for community facilities districts that is inconsistent with other sections of the
Chapter. Previously, Ordinance 07-146 amended Chapter 32, Section 32-18 and 32-57 to
shift the time of, and to strengthen the appraised value requirement for community
facilities district bonds. However, a similar reference in Section 32-24 was overlooked at
that time and needs to be amended to keep the requirements consistent.

A. REQUEST:
Request to amend Chapter 32, Article 2, Section 32-24 of the Hawai County Code pertaining to the waiver
of notice and hearing by petition, to eliminate a reference to the property appraisal requirements for
community facilities districts that is inconsistent with other sections of the Chapter.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Ordinance 07-146 amended Chapter 32, section 32-18 and 32-57 to shift the timing of, and to strengthen the
appraised value requirement for community facilities district bonds. A similar reference in section 32-24 was
overlooked at that time and needs to be amended to keep the requirements consistent.
