Condition P allows for an administrative time extension for a period not to exceed the period originally granted. Based on the reasons stated in your letter, we will grant a 5-year time extension to May 13, 2013 to comply with Condition D (secure Final Plan Approval). As a reminder, based on the requirements of Condition H, if construction does not commence by May 13, 2009, the applicant shall prepare and submit a revised Traffic Impact Analysis for the proposed multiple family'residential development for review and approval of the Department of Public Worlcs, prior to the submittal of plans for Plan Approval Review. Dear Sir: Please accept this correspondence as request for extension of Zoning Ord. No. 03-69 for an additional S years as allowed for in the original Ordinance documents. Background: The owner of Record of TMK 7-5-010:061 is GBH-Kai Maluna, LLC, a partnership which has now been restructured and is wholly owned by MC-G3, LLC, and Gen ill, LLC, both California, LLCs, development entities owned by various members of the Meyer family, which has been active in Commercial and Hotel Real Estate Development for over 50 years. The project associated with this Zoning Ordinance has gone through several permutations over the last 5 years, as market conditions changed. The most recent proposed plans were very close to full approval when the current economic crisis began and halted progress. These plans were for 120 condominium units with clubhouse, pool, landscaping and significant additional amenities. In the recent downturn in the Real Estate market, several partners have now withdrawn from the project, and the Meyer family controls the property. It is our plan to reevaluate the proposed plans, modify them to adjust to the curcent economics of the Kona market, and prepare to restart the project as soon as feasible. While the market is extremely challenging at this time, the lack of current new residential development in the area will produce market demand and opportunities in the future. Bert Meyer and I visited the property in late 2008 and met with Deanne Bugado in the Kona office. Deanne was very helpful and encouraged us to submit this request and the revised project plans which will follow. I believe this project can be a significant benefit to the community and hope to be ready to move forward when economics rebound. We realize there will be further information required in order to grant this extension and look forward to establishing a dialogue with your office to satisfy such requirements.
