RESOLUTION NO. 202 97
RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOTS WITHIN THE
VILLAGES OF LA'I'OPUA, PHASE 1, FROM THE STATE OF HAWAII HOUSING
FINANCE AND DEVELOPMENT CORPORATION, TAX MAP KEYS (3)7-4-20 AND 21
(pORTIONS), TO THE COUNTY OF HAWAII.
WHEREAS, the HOUSING FINANCE AND DEVELOPMENT CORPORATION, a
public body and a body corporate ~nd politic of the State of Hawaii, is the developer of the
Villages ofLa'i'opua, Phase 1, and the owner of those certain roadway lots located in Kealakehe,
North Kona, Hawaii, specifically identified as Tax Map Keys (3)7-4-20 and 21 (portions),
formerly Tax Map Key (3)7-4-08017 (portion), being more particularly described in Exhibit A
of the Deed and delineated on Exhibit B attached hereto, and
WHEREAS, the HOUSING FINANCE AND DEVELOPMENT CORPORATION has
constructed all subdivision improvements as required for final subdivision approval, and
WHEREAS, the HOUSING FINANCE AND DEVELOPMENT CORPORATION has
received approval from the County of Hawaii's Department of Public Works, Department of
Water Supply and the Planning Department for the improvements made to the subject property,
and are desirous of dedicating the subject parcels to the County ?f Hawaii for road, drainage and
wastewater disposal purposes, and
WHEREAS, the subject road, drainage and wastewater disposal improvements have been
completed according to County of Hawaii standards and are in acceptable condition for
dedication, and

WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of
such road, drainage and wastewater disposal improvements be in compliance with Chapter 23 of
the subdivision code; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
Council may accept gifts which include the dedication ofland on behalf of the County of
Hawaii,
NOW, THEREFORE, BE IT RESOL YED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and
Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication deed
for real property identified as Tax Map Keys (3)7-4-20 and 21 (portions) for road, drainage and
wastewater disposal purposes.

That the HOUSING FINANCE AND DEVELOPMENT CORPORATION, a
public body and a body corporate and politic of the State of
Hawaii, whose business and mailing address is 677 Queen Street,
Room 300, Honolulu, Hawaii 96813, hereinafter called the GRANTOR,
in consideration of the sum of ONE DOLLAR ($1.00) to it paid by
the COUNTY OF HAWAII, a body politic and corporate of the State
of Hawaii, whose principal place of business and mailing address
is 25 Aupuni Street, Hilo, Hawaii 96720, hereinafter called the
GRANTEE, the receipt whereof is hereby acknowledged, does ~ereby
bargain, sell, transfer and deliver unto the Grantee the
wastewater disposal system now installed and in existence,

including all pipelines, drainage facilities and appurtenances
attached thereto and found on the premises described as follows:
Lands set aside to the Grantee under Executive Order
No. 3697; set aside to the Department of Transportation
under Executive Order No. 3702; granted and confirmed
to the Grantee under Land Patent Grant No. 5-15,889;
and described under that certain Grant of Non-Exclusive
Easement as Easement 1 of File Plan 2128 and Easement 2
of File Plan 2067, all as more fully described and
shown in Exhibit A, said Exhibit attached hereto and by
this reference made a part hereof.
TO HAVE AND TO HOLD the same unto the Grantee, its
legal successors and assigns, forever.
AND said Grantor, in consideration of the premises,
does hereby remise, release, and quitclaim unto the said Grantee,
its successors and assigns, forever, all of its right, title and
interest, if any, in and to the property herein described.
IN WITNESS WHEREOF, the parties hereto have hereunto
