RESOLUTION NO. 230 98
RESOLUTION AUTHORIZING MULTI-YEAR FUNDING FOR THE STATEWIDE
WASTEWATER TREATMENT WORKS OPERATOR TRAINING FACILITY
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAW Ail.
WHEREAS, the state and counties have constructed a statewide wastewater treatment
works operator training facility; and
WHEREAS, pursuant to Section 44, Act 216, 1987 Hawaii Session Laws, the Legislature
of the State of Hawaii appropriated funds to the Department of Health to administer statewide
wastewater treatment operator training facility only on the condition that the counties also
provide a share of nonstate funds for the operating costs of the facility; and
WHEREAS, pursuant to Section 109(b) of Public Law 95-217, the U.S. Environmental
Protection Agency has awarded a grant of$500,000 to the Department of Health to establish a
facility to train and update wastewater treatment works operation and maintenance personnel on
a statewide basis; and
WHEREAS, the Department of Health desires to obtain the required funding and
participation to operate and maintain the statewide wastewater treatment operator training
facility and the County of Hawaii is ready, willing, and able to provide such funding and
participation; and
WHEREAS, the County of Hawaii's share of the maintenance and operation charges
would be fourteen percent (14%); and
WHEREAS, the projected total operating budget for the facility in the 1998-1999 fiscal
year will not exceed $142,500, and annual increases of the operating budget shall not exceed ten
percent (10%); and

WHEREAS, four (4) votes by the Board of Directors are required to set the annual
operating budget, with the counties and the state each having one (1) vote; and
WHEREAS, Section 10-11 of the Hawaii County Charter requires that any contract, lease
or other obligation requiring the payment of funds from an appropriation of a later fiscal year or
more than one fiscal year shall be made or approved by resolution;
NOW, THEREFORE, BE IT RESOL YED that the County of Hawaii, through its
Department of Public Works, is authorized to enter into a multi-year Memorandum of
Agreement For The Statewide Wastewater Treatment Works Operator Training Facility, for the
operation and maintenance of that facility as set forth above.
BE IT FURTHER RESOL YED that a copy of this resolution be forwarded to the Mayor
and to the Chief Engineer.
