<br />. . <br /> <br />. <br /> <br />. <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. <br /> <br />2.41 98 <br /> <br />RESOLUTION AMENDING RESOLUTION NO. 192-97 RELATING TO THE <br />SPECIAL FUEL TAX PROGRAM. <br /> <br />WHEREAS, Resolution No. 192-97 proposed to fix, determine, and set the amount <br />of County of Hawaii fuel tax to be levied and collected by the Department of Taxation of <br />the State of Hawaii pursuant to Section 243-5, Hawaii Revised Statutes; and <br /> <br />WHEREAS, in accordance with said section, the Council, following two public <br />hearings, adopted Resolution No. 192-97 on January 21, 1998; and <br /> <br />WHEREAS, Resolution No. 192-97 set the fuel tax to be imposed on the sale or <br />use of gasoline and other liquid fuel at 8.8 cents per gallon for diesel on-highway and <br />gasoline at 6.8 cents per gallon for liquefied petroleum (LPG) on-highway until June 30, <br />2008; and <br /> <br />WHEREAS, according to Section 243-4(c)(2), Hawaii Revised Statutes, the rate <br />for LPG should be equal to two-thirds of the applicable diesel oil rate, rounded to the <br />nearest cent; therefore, according to the following formula, the rate for LPG is limited to 6 <br />cents per gallon (~.8 cents X 2/3 = 5.8666 = 6). <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE <br />COUNTY OF HAW All that the LPG rate fixed, determined and set in Resolution No. <br />192-97 shall be amended from 6.8 cents to'6 cents per gallon. <br /> <br />BE IT FURTHER RESOLVED that this resolution shall take effect in accordance <br />with provisions incorporated in Section 243-5, Hawaii Revised Statutes, and shall continue <br />in effect until June 30, 2008. <br /> <br />BE IT FURTHER RESOLVED that if any provisions of this resolution or the <br />application thereof to any person or circumstances is held invalid, such invalidity shall not <br />affect other provisions or applications of this resolution which can be given effect without <br />the invalid provision or application, and to this end the provisions of this resolution are <br />declared to be severable. <br /> <br />1 <br />
