Your Committee on Finance, to which was referred Resolution No. 94, reports as follows:
Resolution No. 94, transmitted by Finance Director Hany Takahashi, via Communication
No. 314, dated May 6, 1997, authorizes the County Of Hawaii to enter into an agreement with
the United States of America for a Statewide Marijuana Eradication Grant.
The United States of America through the State Department of the Attorney General Crime
Prevention and Justice Assistance Division, is desirous of providing funding for expenses to
conduct mazijuana missions. The Hawaii County Police Department is ready and willing to
proceed with its obligations to operate these missions.
Pursuant to Section 46-7 oY'the Hawaii Revised Statutes, the Federal Government may enter
into agreements with the Council of the County of Hawaii providing the expenditures or
receipt of funds or for other assistance. The Mayor is hereby authorized and designated to
sign in the name of the County Project Number 96-DB-13, which will effectuate these
purposes.
Resolution No. 94 was first heazd at the June 3, 1997 Finance Committee meeting. At that
time, numerous public testimony was heazd in opposition of Resolution No. 94. Your
committee voted to defer the measure pending a special meeting where the Police Department
would he present to answer questions posed by committee members.
Today's special Finance Committee meeting included numerous testimony both in favor and
in opposition of the marijuana eradication program. In favor of the program, were members
of the Hawaii County Police Department, State Narcotics Task Force, Federal Drug
Enforcement Agency, and the United States Attorney General's Office.
Today's discussion examined the County's responsibility to conduct a mandatory program
review of the Statewide Marijuana Eradication Program, and allowed the Police Department
an opportunity to address allegations ofnon-compliance with grant conditions.

To address concerns relating to a program review, Your Committee, upon motion by
Ms. Leithead-Todd, amended Resolution No. 94 to include the following language:
"WHEREAS, public concerns on the effectiveness of the mazijuana eradication
program warrants a more comprehensive program review of the funding in operations
of the program.
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it requires as a condition of County Project Number 96-DB-13 and its
accompanying grant agreement that some of the funds be expended on a program
review of the marijuana eradication program. The program review shall be submitted
to the Council within 90 days of the grant's termination or sooner."
A majority of Your Committee members voted to pass Resolution No. 94, as amended, with
two opposing votes from Committee members AI Smith and J. Curtis Tyler who felt the grant
monies were not expended properly.
Your Committee on Finance is in accord with the purpose atld intent of Resolution No. 94,
Draft 2, and recommends its adoption.
