Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 127, regarding Resolution 5]-09, reports as follows:
Resolution 51-09, transmitted by Assistant Corporation Counsel Gerald Takase via
Communication No. 127, dated February 3, 2009, accepting the dedication of Road Lot A (Maunale`o
Place), Road Lot B (Maunanani Place) and Road Lot C (Maunakeha Way), being Tax Map
Keys: (3) 9-9-010-041, 042 and 043, situate at Keauhou, District of Ka`u, County and State of Hawaii
from Volcano Fairways Development Corporation.
There was no testimony from members of the public regarding the proposed resolution.
Article X1I1, § L3-12 of the Hawaii County Charter provides that the Council may accept gifts, which
include the dedication of land, on behalf of the County of Hawaii.
Volcano Fairways Development Corporation is desirous of dedicating Road Lot A (Maunale`o Place),
Road Lot B (Maunanani Place) and Road Lot C (Maunakeha Way), including all subdivision
improvements.
Assistant Corporation Counsel Gerald Takase appeared before your Committee. Mr. Takase commented
that the Volcano Fairways Development Corporation met all requirements and is in full compliance
according to County of Hawaii standards.
Councilmember Dominic Yagong commented on the increasing inventory of such roads dedicated to the
County. Mr. Yagong is concerned of the ongoing maintenance, liabilities and financial impact,
especially at this time during the economic crisis. Furthermore, Mr. Yagong added that from a policy
standpoint, this particular issue will need to be discussed at another time as it does not apply to this
proposed resolution.

intent of Resolution 51-09, and recommends its adoption.
