Council Chair and Members Hawaii County Council Hilo, [-Iawai`i 96720 Re: Comm. No. 128/Res. 52-U9 Your Committee on Public Works and Intergovernmental Relations, to which was referred Communication No. 128, regarding Resolution 52-09, reports as follows: Resolution 52-09, transmitted by Assistant Corporation Counsel Gerald Takase via Communication No. 128, dated February 4, 2009, authorizing the acquisition of private property by eminent domain, being a portion of Tax Map Key: (3)] -7-031:010, situate at Kea`au, in the District of Puna, County and State of Hawaii, for access to Happy Homes, from Cecelia Mae Chun and William H. Hosnneyer. The purpose of Resolution No. 52-09 is to authorize the County, pursuant to Section 101-13 of the IIawai`i Revised Statutes, which requires Chat condemnation action by the County must be authorized by a resolution of the County Council. "Chere was no testimony from members of the public regarding the proposed resolution. Assistant Corporation Counsel Gerald Takase appeared before your Committee. Mr. Takase commented that this proposed resolution authorizes the acquisition of private property by eminent domain for the roadway improvement fo Momona Road and I-sappy I-Iomes Access Road. Councilmember J Yoshnnoto commented that a previous resolution was adopted by the Council agreeing to road improvements for this community. Furthermore, Mr. Yoshimoto stated this project has been on-going for over 10 years and would like to commend Mr. Takase for his assistance in this matter. He seeks the support of his colleagues on this proposed resolution. Council Chair Brenda J. Ford questioned the value of this property and amount that will be paid to owners. Mr. Takase responded the minimum value of this property is assigned at zero (0).
