Re: Amendment to the Hawai'i County Code
As presented in Mayor Billy Kenoi's budget message, to balance the operating budget
for fiscal year 2010, a moratorium of the transfer of 2% of real property tax revenue,
including penalties and interest, to the Public Access, Open Space, and Natural
Resources Preservation Fund, would be required for the next two fiscal years. In
addition, by making the moratorium effective on January 1, 2009, this would help to
increase the fund balance for next year since health care premiums and other amounts
in the budget have not yet been finalized and may need to be increased in the Mayor's
May 5th amended budget. This additional fund balance would help to create a revenue
source for these increases.
Enclosed is a bill for an ordinance amending Chapter 2, Article 42, Section 2-214 of the
Hawai'i County Code 1983 (2005 Edition, as amended) relating to the Public Access,
Open Space, and Natural Resources Preservation Fund. This amendment suspends
the transfer of 2% of real property tax revenue, including penalties and interest, to the
Public Access, Open Space, and Natural Resources Preservation Fund, effective
January 1, 2009. In addition, the amendment will also eliminate the minimum transfer
amount of $250,000 that is currently required in the Hawai'i County Code.

A. REQUEST:
A bill to suspend the transfer of 2% of real property tax revenue, including penalties and interest, to the
Public Access, Open Space, and Natural Resources Preservation Fund (PONC fund) effective 1/1/09. In
addition, the bill should also eliminate the minimum transfer amount currently required in the Hawaii County
Code.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
