We are writing to provide more information to the Planning Department on our
(progress toward completion of the requirements of our Change of Zone.
The Public Works Department and the Department of Water Supply concerns have
been addressed by Triad Engineering. Our revised construction drawings are being submitted
for County review.
Compliance with each condition of the ordinance is as follows:

Approval: five years, or by Feb. 12, 2007
Aug. 14, 2007 Effective date of Ordinance No. 07 106, amending

Extension of Time to secure Final Subdivision
Approval: five years, or by August 14, 2012
(D) (2) The property is dedicated for agricultural uses with the
Department of Finance, Real Property Tax Division,
and is presently being grazed.
(E) An archaeological reconnaissance survey report was submitted,
accepted by the Department of Land and Natural Resources,
Historic Sites Section, and approved by the Planning Department.
(F) If archaeological sites or features are uncovered, work will cease and
the Planning Director will be notified.
(G) A drainage system is being installed to County standards.
(H) There will be one access to the subdivision from Ala Kahua Drive.
(I) A solid waste management plan will be submitted.
(1) All applicable laws, rules, regulations & requirements will be complied with.
(K) Unified Impact Fees will apply to project, if adopted by council.
(L) Affordable Housing requirements will be met.
(M) Annual progress reports are submitted to the Planning Director.
(N) Additional time extension requests, if necessary, will be submitted to the
Hawaii County Council.
(O) If conditions are not met, the Director shall initiate rezoning to appropriate
designation.
We have applied for, and received, the necessary time extensions,
including August 14, 2007 Ordinance No. 07 106 and an
Extension of Time to secure Final Subdivision Approval for
five years, or by August 14, 2012.
