Your Committee on Planning, to which was referred Bill No. 32, reports as follows:
Bill No. 32, transmitted via Communication No. 147 from Mayor William P. Kenoi, dated
February 3, 2009, presents a Change of Zone Request by S. Russell and Akiko Oda, at Waiakea
Houselots, Waiakea, Hawaii, TMK: 2-2-034:036.
Bill No. 32 seeks to amend Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code 1983 (2005 Edition), by changing the District
Classification from Single-Family Residential - 10,000 square feet (RS-10) to Neighborhood
Commercial - 10,000 square feet (CN-10) at Waiakea Houselots, Waiakea, Hawaii, covered by
TMK 2-2-034:036.
Communication No. 147 reports that the Hawaii County Planning Commission, as required by
Chapter 4, Sec. 6-4.3(C), Hawaii County Charter, considered the above request on January 15,
2009. The Commission concurred with the Planning Director's reasons for recommending
favorable consideration of the change of zone. Communication No. 147 transmits the following
findings and recommendations:
1. The subject property is located in the Waiakea Houselots Subdivision. Adjacent property
to the north and the south are zoned CN-7.5. The property is landscaped and there is a
single-family dwelling on the site. The land uses in the area are a mix of residential and
commercial uses. The State Land Use designation for the subject property is Urban.
2. Applicant is requesting a change of zone for approximately 22,500 square feet in size
from Single-Family Residential - 10,000 square feet (RS-10) to Neighborhood
Commercial - 10,000 (CN-10), to convert an existing single-family dwelling into an
office building to be leased to supplement the applicants' retirement income.

3. The property is owned by the Akiko K. and Shigeyasu Russell Oda Trust.
4. Access to the subject property is from Manono Street, a County roadway with a
right-of-way of 50 feet fronting the subject parcel. According to the City of Hilo Zone
Map, Manono Street is proposed to be widened to a 60-foot right-of-way, thus affecting
five feet of properties along Manono Street. The Department of Public Works
recommends that access be limited to a single location on Manono Street.
5. County water is available to the site.
6. Utilities are available to the site. County fire stations, police and emergency medical
services are available to the site.
7. The Planning Director recommended favorably on this request based on the following:
• The proposed change of zone request will conform to the goals, policies and
standards of the General Plan Economic and Land Use Elements.
• The Land Use Pattern Allocation Guide (LUPAG) Map designates this area as
Medium Density Urban.
• The State Land Use designation for the property is Urban and the proposed change of
zone would complement the existing uses already in the area.
• The Change of Zone request is not contrary to Chapter 205A, Hawaii Revised
Statutes relating to Coastal Zone Management as the subject property is not an
oceanfront parcel, and will not affect or be affected by shoreline processes.
• There are no valued cultural, historical or natural resources that exist on the property
and no evidence of any traditional and customary native Hawaiian rights being
practiced on the site. It is not anticipated the proposed request will have any adverse
impact on cultural or historical resources in the area.
The applicant S. Russell Oda, was present but did not appear before the Committee. He was
represented by Sidney Fuke, Planner. Mr. Fuke informed the Committee that the applicant had
no immediate plans to convert the existing rental unit. He further informed the Committee that
the applicant was negotiating with businesses on Hinano Street, located behind the subject
property, regarding the possibility of making the lot a parking lot. This would alleviate some of
the parking congestion on Hinano Street.
Council Member Dennis "Fresh" Onishi informed the Committee that he received no negative
comments regarding the application. Mr. Onishi stated that he supported the application.

Council Member Brenda Ford said that she was very happy to hear that the applicant was
considering making the property into a parking lot. Council Member Pete Hoffmann stated that
while he was in favor of the application, he would be voting against the application due to his
opinion regarding fair share assessments. Council Member Kelly Greenwell stated that he felt is
unfair to "hold applicants hostage" because of one Council Member's stance on fair share
assessments. Mr. Greenwell stated that he too, had reservations about the current system. He
stated that he wished the matter would be settled once and for all, but that he would be voting in
support of the application since it was a good project. Mr. Greenwell stated that he wanted to be
fair to the applicant.
Your Committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of the Change of Zone request.
Your Committee on Planning is in accord with the purpose and intent of Bill No. 32 and
recommends it pass first reading.
