RESOLUTION AUTHORIZING THE ABANDONMENT, SALE AND ACQUISITION OF
REAL PROPERTY WITH RANDOLPH AND SUSAN CABRAL, TAX MAP
KEY: (3)2-6-010:060, SITUATE AT KAIWIKI, SOUTH HILO, HAWAII.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Kaiwiki Road, which is owned and maintained by the County of Hawaii,
encroaches on the southern portion of property owned by Randolph and Susan Cabral, identified
as Tax Map Key: (3)2-6-010:060, situate at Kaiwiki, in the District of South Hilo, Island, County
and State of Hawaii; and
WHEREAS, the County of Hawaii is the owner of aright-of--way designated as Road
Remnant "A," (outlined in green on the attached map), containing an area of 2,488 square feet,
that is not in use; and
WHEREAS, to correct this encroachment, Randolph and Susan Cabral wish to purchase
Road Remnant "A" from the County of Hawaii;
WHEREAS, Randolph and Susan Cabral also agree to sell to the County that portion of
their property (outlined in pink on the attached map), containing an area of 3,369 square feet; and
WHEREAS, the abandonment, sale and acquisition is advantageous to the County of
Hawaii in that it is the current alignment of the paved roadway; and
WHEREAS, Pamela Brand and the Stanton C. Oshiro Trust, as co-owners of Kaiwiki
Estates, the owner of Tax Map Key: (3)2-6-010-011, the adjoining parcel to Road Lot "A," have
relinquished any interest in purchasing Road Remnant "A"; and
WHEREAS, Sections 2-1 l land 2-118, Hawaii County Code, allows for the disposal of
remnant parcels.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the right-of--way designated as Road Remnant "A" outlined in green on the
attached map is hereby abandoned and discontinued as a County road.
BE IT FURTHER RESOLVED that in accordance with Sections 2-111 and 2-118,
Hawaii County Code, the Director of Finance is authorized to sell to Randolph and Susan
Cabral Road Remnant "A" outlined in green on the attached map, for that portion of their
property outlined in pink on the attached map, subject to the County of Hawaii assuming all
other costs involved in the sale and acquisition.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of
Hawaii; (2) Nancy Crawford, Director of Finance; (3) Warren H.W. Lee, Director of Pubic
Works; (4) Deputy Corporation Counsel Gerald Takase; and (4) Randolph and Susan Cabral,
2578 Kaiwiki Road, Hilo, Hawaii 96720.
